PERMIT #: M- 1990 -144 <br />INSPECTOR'S INITIALS: TC1 <br />INSPECTION DATE: March 4, 2014 <br />OBSERVATIONS <br />This inspection was initiated by an application for succession of operator (SO). The focus of this inspection <br />was to assess the operation status and determine what, if any activities might have an impact of the financial <br />warranty liability. Mr. Ron Fillmore represented the new Operator. Ms. Amy Eschberger and Mr. Elliott <br />Russell (representing the Division) accompanied this specialist on the inspection. <br />This Boone - Fillmore Pit is located approximately six miles southeast (along State Highway 96) of Boone, Colorado in <br />Pueblo County. <br />File Review Notes: <br />• This site was mined by Western Mobile Southern and not used by Lafarge after the succession of <br />operator in July 2002. <br />• The current financial warranty is $77,447. This is deemed near adequate for the estimated 40 acres of <br />disturbance (based on Lafarge's 2013 annual report). <br />• The post mine land use for the permit area is rangeland. <br />• Annual fees and reports are up to date through 2013. <br />• The previous inspection was conducted on August 5, 2009. One problem was cited, requiring the <br />removal of tamarisk. The Division has no record of this problem being resolved. <br />• The permit boundary is an irregular shape and does not match the boundary provided in Lafarge's 2013 <br />annual report. This along with the lack of boundary markers is cited as a problem on page 1 of this <br />report. The original permit map (showing metes and bounds) and the Division's recreated map (with <br />satellite image background are included as Attachment 1. <br />Inspection: <br />The permit sign was posted at the site entrance (see Photo 1). The Operator needs to add a name and contact <br />phone number to the permit sign. No boundary markers were observed. <br />A large stockpile of material was observed east of the haul road (see Photo 2), and some smaller stockpiles <br />scattered across the site (see Photos 3 - 6). The site is partially self reclaimed and there is evidence of seeding <br />with successful vegetation establishment as well. A large slash pile of what appeared to be tamarisk was <br />observed (see Photo 7) and should be removed. Some smaller tamarisk were observed northwest of the slash <br />pile. These should be removed as well by implementing a noxious weed control program. <br />With the exception of the stockpiles, the site appears to be graded to slopes flatter than the required 3H:1 V. <br />Some minor erosion rills were observed on the stockpiles, but given the nearly flat gradient of the site, eroded <br />sediments were confined to the base of the stockpiles. <br />This specialist explained that if no material is sold, processed or excavated for more than 180 days, but mining <br />is still expected to occur, the permit should be in temporary cessation (TC). Given there is no schedule for <br />mining the site and the Lafarge 2013 annual report indicates no mining has occurred since before 2000, Mr. <br />Fillmore was encouraged to apply for TC. A form to apply for TC is included as Attachment 2. <br />Summary and Recommendations: <br />Site activity has been limited since before 2000. However, the new operator expressed intent to extract <br />additional aggregate from this site. As such, the following issues need to be addressed prior to extracting <br />additional aggregate material: <br />Page 2 of 5 <br />
