April 8, 2014 <br />CledFCFeek County <br />POST OFF'IGE BOX 2000 <br />GEORGETOWN, COLORADO 80444 <br />TELEPHONE: • (303) 679 -2300 <br />Michael Cunningham, Environmental Protection Specialist <br />Division of Reclamation, Mining and Safety <br />Department of Natural Resources <br />1313 Sherman Street, Room 215 <br />Denver, CO 80203 <br />RE: Capital Prize Mine; File No. P- 2014 -005 <br />Dear Mr. Cunningham: <br />The Clear Creek County Land Use Division has reviewed the Notice of Intent to Conduct Prospecting Operations <br />submitted by Maisie Mining Company and has the following comments to offer. <br />Because the maps accompanying Form 2 were non - specific, we mapped the 5 claims identified in the submittal <br />(Aetna, Comet, Capital Central No. 3, Capital Central No. 5 and Capital Central No. 6) and have included the map <br />as Attachment 1 to this letter. This map is a visual representation only, and it is not survey accurate. It does, <br />however, provide a visualization of the project area. <br />Ownership <br />According to County records, the claims are not owned by Maisie Mining Company. Our records indicate that the <br />Aetna and the Comet are owned by Capital Prize Mine 1 LLP. The Capital Central No. 3, No. 5 and parts of No. 6 <br />are owned by Clear Creek County (Surface Rights and some Mineral Rights) and Capital Prize Mine 1 LLP <br />(remaining Mineral Rights). Please see the Warranty Deed for these claims, with specific attention to Exhibit B <br />which limits the development and exercise of the Mineral Rights associated with these claims (Attachment 2). . <br />An Easement Agreement relating to the Capital Central No. 3 and No. 5 (Attachment 3) also specifies conditions <br />regarding access and mining related uses for these claims. <br />Comment 1: Because of these circumstances, we suggest that the applicant provide clear documentation regarding <br />ownership and right to enter, that the applicant illustrate the location and extent of the proposed activity, and that the <br />conditions relating to the mining activity and access for the Capital Central No. 3, 5 and 6 be recognized on the <br />application. <br />Tunnel Use — No Pits, No Ponds <br />Page 4, Item 11 of the Notice states that the Capital Prize Mine main tunnel will be used and that blockages will be <br />removed. Based on comments and observations from area residents, it is possible that the removal of the blockages <br />could cause an increase in the discharge from the tunnel, which is within the Town of Georgetown, adjacent to <br />residences. <br />Comment 2: We suggest that this possibility of increased drainage be addressed in the NOI. <br />RECEiV�.�'�� <br />Tunnel Access to All Proposed Prospecting Areas <br />APR 1020°,, <br />Division of Reclamation. <br />"Honoring Our Past, While Designing Our Future" Mining & Safety <br />
