March 18, 2014 C- 1981- 012/New Elk Mine LDS <br />One proposed idea was for LS to generate an adequacy letter for RN6 (which is already <br />in progress), incorporating all of the points from MT6, together with any new issues that <br />have arisen, and an updated cost estimate. NECC could withdraw TR68 and submit a new <br />TR in response to RN6. This could certainly include changes to the re- vegetation plan <br />that are already under review by CO Parks and Wildlife, and the proposed section 3.0 that <br />details some cost estimating parameters. Additionally, some of the maps that were <br />submitted for TR68 could be altered to reflect the change in date and permitting action; <br />maps requiring more significant alterations would need to be re- submitted anyway. <br />Action items: <br />a. LH, JT, MV and RT to decide how they wish to proceed it is not out of the <br />question to continue with the TR68 process that has been started, but it could be <br />quicker to start afresh. Also decide whether to complete the process in- house, or <br />contract with Gorham Energy Consultants. <br />7. New Elk, on the ground compliance <br />Pond 7 <br />DWDA2 <br />Temporary DWDA <br />Action items: <br />a. NECC to seek approval from CDPHE for the use of fZocculant and discharge <br />pond 7 to approved level ASAP <br />b. NECC to set up staff gauge in pond 7 <br />c. NECC to reshape DWDA2 and have it certified by a Professional Engineer <br />(surplus material could go to Temporary DWDA). Surrounding ditches to be <br />restored to approved design. <br />d. NECC to move material from Temporary DWDA, by either haul road or <br />conveyor, to RDA. In either case, the structure will need to be approved via a TR <br />first. (See rule 4.03.1 for haul road criteria) <br />8. Golden Eagle bond release <br />The possibility of submitting a bond release application was briefly discussed. <br />NECC may wish to retain the GE site for future operations.
