PLS Response: PLS is the owner of record of the surface and mineral rights of the affected land. Please <br /> see attached affidavit of newspaper publishing and return-receipts for property owner and easements <br /> within 200'of affected land <br /> Application Form <br /> 3. The Application Form indicates that the permit area is being increased from 270 acres to 276 acres. <br /> However, our records indicate that the permit area for the Owl Canyon Quarry is 161.5 acres. The <br /> Division discussed this discrepancy with the Operator (see attached correspondence) prior to the <br /> submittal of this Amendment Application and instructed the Operator to provide a summary of the <br /> additions and deletions to the permit area along with the associated permitting actions. A review of <br /> the Amendment Application found that no such summary was provided. In order to correct any <br /> potential errors that were made in the permit file, the Operator must provide an accounting summary <br /> which demonstrates that the permit area is currently 270 acres. Please respond. <br /> PLS Response: PLS concludes that the in the timeframe between 1998 through 1999, the additional <br /> acreage was introduced through mapping and reporting in the permit actions during this time period. PLS <br /> continued to provide maps and reporting of activities on the 270 acres as required to present time. PLS <br /> assumed the represented permit boundaries supplied with the mapping provided during permitting actions <br /> during this timeframe has and was approved and permitted by the Colorado Division of Reclamation, <br /> Mining, and Safety. <br /> As such, the current Construction Materials Regular 112 Operation Reclamation Permit Application has <br /> been provided to increase the agreed upon 270 acres by an additional 6 acres to allow for a permitted well <br /> and access road required for future reclamation. The map submitted for Exhibit C has a scale of I inch equals 660 feet. However, the scale <br /> Bar on the map is not equal to an inch, but rather measures to 9/10"of an inch. Please <br /> confirm that the map is set to the specified scale or revise the Mining Plan Map accordingly. <br /> PLS Response: Please see revised Mining Plan Map (Exhibit C). <br />
