In accordance to Rule 2.03.4(6)(a) to (c) and Rule 2.10.3(a); please review sections 2.03.4(6)(a)(b)(c) <br />and section 2.03.6 of the Keenseburg Strip Mine permit as well as the Surface and Mineral <br />Ownership Map presented in Appendix A -2 of the permit. Please update and provide the names and <br />addresses of the owners of the surface lands within the permit area and the owners of minerals rights <br />under the permit area and update the Appendix A -2 map accordingly. <br />SECTION V - PERMIT VARIANCES AND SPECIFIC APPROVALS <br />As discussed above, variances to contemporaneous reclamation were granted during the mining operation for <br />the backfilling and grading of Pit A(completed) and Pit B. CEC requested additional time for backfilling and <br />grading following coal removal from the contour strip mine. The Division approve the additional time per <br />Rule 4.14.1(1). A variance was granted on February 28, 1989 to allow for the use of the A and B pits as ash <br />and mine waste rock disposal sites (Technical Revision 20). As discussed in item no. 2 in section IV above, <br />future ash disposal at the site will need to be evaluated and the variance approval extended if need be. <br />SECTION VI — BONDING SUMMARY <br />In accordance with Rule 3.02.2(4) the Division has reviewed the adequacy of the reclamation bonding <br />instruments and we have also reviewed the adequacy of the reclamation cost estimate, pursuant to this mid- <br />term permit review. There is currently a Corporate Surety in place for the Keenesburg Strip Mine in the <br />amount of $1,937,676.00. The Division calculated a new reclamation cost estimate taking into account the <br />remaining tasks to be completed that have not been released through the phased bond release process. The <br />Division estimated the reclamation cost to be $1,971,874.00 which is $34,198.00 more than the current bond <br />held. Enclosed with this document is a copy of the Division's estimate. CEC will need to revise Appendix S <br />of the permit application package to reflect the updated cost estimate as discussed in section IV of this <br />document. <br />The Division will be initiating a bond adjustment as discussed in Rule 3.02.2(4). <br />5 <br />
