SECTION II - REVISIONS TO THE PERMIT <br />The following is a summary of revisions to the permit since the RN6 proposed decision dated September 7, <br />2011. <br />SECTION III - STATUS OF STIPULATIONS <br />There are no stipulations on this permit at this time. Stipulations 1 through 4, 6 through 16, and 18 of the <br />original permit were resolved during the first five -year permit term. Stipulations 19, 22 and 27 were resolved <br />during the second five -year permit term. Stipulations 5, 17, 20, 21, 23, 24, 25, 26, 28, 29, 30 and 31 were <br />resolved during the third five -year permit term. <br />SECTION IV — Midterm Adequacy Review and Request for Revision <br />Pursuant to Rule 2.083, the Division has conducted a midterm review and has found that certain <br />modifications are needed to ensure future compliance with the Colorado Surface Coal Mining Reclamation <br />Act and the Regulations of the Colorado Mined Land Reclamation Board for Coal Mining. Coors Energy <br />Company must submit a Minor Revision by June 3, 2014 to address the following items: <br />During the review of the 2012 annual reclamation report, it was noted that the regression equation <br />used to determine the total vegetation cover success standard for reclaimed areas is incorrect. Page <br />116b of the permit indicates the equations is y= .0127x3 + .2115x2 + 2.1772x. The equation should <br />read y =- .0127x3 + .2115x2 + 2.1772x. Please revise page 116b of the permit with the correct <br />equation. <br />2. Page 117 of the permit indicates the last year of ash and mine waste rock disposal at the site is <br />estimated to be 2020. Also, the third paragraph of this page indicates CEC has been granted a <br />variance on performing contemporaneous reclamation for the B -Pit area until March 2014. Please <br />evaluate the estimated end date for disposal activities at the site and if the variance on performing <br />contemporaneous reclamation for the B -Pit is still necessary. If CEC plans to continue backfilling 13- <br />Pit with fly ash and mine waste rock it is likely the variance will need to be extended. Please revise <br />Page 117 accordingly. <br />The reclamation cost estimate contained Appendix S of the permit application package will need to <br />be updated based on the current reclamation cost estimate for the site.
