I SAFETY <br />RE: Notice of Intent to Conduct Prospecting Application; Red Cone; File No. P- 2014 -003; <br />Notice of Deficiencies <br />Dear Mr. Caccamise, <br />On February 28, 2014, the Division of Reclamation, Mining and Safety (Division) received the <br />Notice of Intent (NOI) to Conduct Prospecting Application for Red Cone, File No. P- 2014 -003. <br />The Application was filed for review on March 17, 2014. Our review indicates the NOI <br />application contains deficiencies as defined by Rule 5.1.3 of the Mineral Rules and Regulations <br />of the Colorado Mined Land Reclamation Board for Hard Rock, Metal, and Designated Mining <br />Operations. The Division requires the information described below before we can approve the <br />NOI application. <br />1. The Application was submitted by `Sierta LLC'. A search of the Colorado Secretary of State <br />(SOS) website found that `Sierta LLC' is not a registered company in the state of Colorado. <br />The Division cannot issue an NOI to `Sierta LLC' until the company has been registered with <br />the SOS. You many register the company name at http: / /www.sos.state.co.us /. Please provide <br />the Division with documentation the Sierta LLC has been registered with the SOS. <br />2. The Applicant listed `individual' for the Title on the Page 9 of the Application form. If the <br />Application is being applied for in the name of Sierta LLC, then the Title should reflect the <br />information provided on Page I of the Application form. Please revise the Title field on Page <br />9, of both Form 1 and Form 2, from `Individual' to `President of Sierta LLC'. <br />3. The Applicant has stated that the mineral(s) to be investigated are sources of metal <br />contamination of water in Handcart Gulch. The Hard Rock Rules define prospecting as the <br />act of searching for or investigating a mineral deposit. The definition of prospecting includes, <br />but is not limited to, sinking shafts, tunneling, drilling core and bore holes and digging pits or <br />cuts and other works for the purpose of extracting samples prior to the commencement of <br />development or extraction operation. It is not apparent that your proposed activity will <br />require an NOI.
