caused by filling the two lakes will be replaced pursuant to this plan for augmentation or <br />otherwise through water made available through exchange from the Aspinall Unit. <br />28. The calculations of wetland irrigation (evapotranspiration) are summarized in <br />Table 3, which were made for medium density hydrophytes. On the basis of temperature <br />data published for the Gunnison Weather Station, the ice free period was taken as beginning <br />on March 25 and ending on October 25. The net wetland irrigation (evapotranspiration) rate <br />is 2.95 feet for a total of 10.05 acre feet for the 3.4 acres of wetlands expected to be <br />developed around the perimeters of the two lakes. <br />29. The monthly and annual water depletions at the Tomichi Pit after reclamation <br />has been completed are shown in Table 4. The water depletions have been estimated at a <br />total of 129.4 acre feet, of which a total of 103.8 acre feet will occur during May through <br />September and 25.6 acre feet will occur during October through April. Assuming a river call <br />is affecting the water uses at the Tomichi Pit during the entire year, these are the maximum <br />depletions to be replaced under the Plan for Augmentation. As shown in column 5, the <br />maximum rate of water depletions after mining operations are completed will be 0.43 c.f.s. <br />(193 g.p.m.) in June, .38 c.f.s. for the Tomichi Pit — Phase 1 and .05 c.f.s. for the Tomichi Pit <br />— Phase 2. <br />30. The Applicant proposes to use two sources of replacement water for the Plan <br />for Augmentation. During May through September, water depletions can be replaced using <br />the Biebel Ditch water rights corresponding to the areas removed from irrigation within the <br />Tomichi Pit boundary area. As necessary, the water depletions during October through April <br />can be replaced with consumable Aspinall Unit water purchased from the United States <br />Bureau of Reclamation. The controlling water rights on Tomichi Creek and the Gunnison <br />River downstream from the Tomichi Pit normally are those for the Gunnison Tunnel, <br />Redlands Power Canal and the Aspinall Unit. Because the Gunnison Tunnel and Redlands <br />Power Canal are downstream from the Aspinall Unit, Aspinall water is an appropriate water <br />source with which to replace the out of priority depletions at the Tomichi Pit during October <br />through April. <br />31. Applicant proposes to establish CU credits by the removal from irrigation of <br />lands historically irrigated with the Biebel Ditch rights. The CU credits and monthly <br />volumes of return flow water were determined for the Biebel Ditch rights by this Court in <br />Case No. 06CW123.
