Box 191, Victor, CO 80860 Division of Reclamation, <br />Mining & Safety <br />RE: Squaw Mountain Radio Relay Tower and Access Road — 0.4 acres total disturbance <br />Pad Site - Part Described in 459842 of S30- T15 -R69W 6th PM (80053039/1003.301000010) <br />Access Road — N0024865, N0024877, N0025130, N0024157, N0025242, N0025249, N0025280 <br />Dear Mr. Hanks; <br />Teller Planning has received your application and supplemental information for a Minor Modification to the <br />CCV Mining Development Plan (MDP — Amendment 10 of Permit No. M- 1980 -244). The application seeks to <br />relocate the existing radio relay facility currently located north of the Ajax' -- Eoratlon Building to a point on <br />the North Slope of Squaw Mountain. This relocation will mean the dismantling and demolition of all facilities <br />and infrastructure at the currently existing site (which will ultimately be mined) followed by placement of five <br />(5) new light- weight panel antennas, and the supporting electrical panel and other cabinets or accessory <br />equipment, all to be mounted on a new 40 -foot high self - supporting Rohn Model 25G cross - braced hot -dip <br />galvanized 3 -sided fixed -base lattice tower on a concrete pad. This application also includes the installation of <br />a ±15' wide by ±1,123- foot long private access road (complete with berm), electrical tie -in with Black Hills <br />power, and a 0.5 acre disturbed area land swap from N0025023 to the new facility site (see Technical Revision <br />69). <br />The application has been reviewed and assessed for compliance with LUR Section 8.B of Appendix A: <br />CCMOD, the "Contractual Agreement for Victor - Goldfield Buffer Area and Cripple Creek Historic/Recreation <br />Area Related to the Cripple Creek Mining District" recorded 06/27/2000 at Reception No. 506476, and <br />Resolution 09 -12- 2012(39) approving MLE2 recorded at Reception No. 656481. Based on the submitted <br />construction and site plans and a site visit conducted on February 10, 2014, and pursuant to LUR Section 8.B <br />Minor Modification of an MDP staff finds that this MDP minor amendment as submitted and conditioned below <br />satisfies all of the criteria of LUR Section 8.3.B as follows and is hereby conditionally approved and authorized: <br />a. There is no increase in the affected acreage of the Mined Land Reclamation Permit issued by <br />the State of Colorado and, as applicable, is consistent with the previous level of disturbance. <br />b. The change remains within the affected Mined Land Reclamation Permit boundary. <br />c. There is no material change in the approved Mined Land Reclamation Permit, nor any change <br />in the approved post - precious metal mining use. <br />d. There are no material additional demands on Teller County services or infrastructure. <br />e. The change has no impact on adjoining land uses which cannot be mitigated. <br />f. The activity does not impact Section 7 Mining Development Plan Standards including <br />submittal requirements, noise, lighting/glare, public roads, sewage management, visual <br />resources, state /federal approvals, structures, emergency response, signs/berms /fencing, <br />drainage, reclamation, and new technologies or mining practice. <br />g. The terms and conditions attached to the approved MDP are not affected. <br />h. The activity itself, if not its particulars, is part of the approved MDP. <br />.../2 <br />
