D. Sedimentation Ponds <br />The Division does not propose to approve the submittal of reports required by <br />Rule 4.05.6(13) on other than a quarterly basis. The report submittal is <br />quarterly. <br />2. Alternative design criteria and specifications have not been approved for use in <br />sediment pond design and /or construction at this time. (4.05.6(l 1)) <br />E. Acid - forming and Toxic - forming Spoil <br />No specific approvals are granted under this section. <br />F. Impoundments <br />1. The applicant has not proposed the use of alternative design criteria and <br />specifications for impoundment design and construction. (4.05.9(4)- (6)) <br />G. Surface and Ground Water Monitoring <br />The requirement for hydrologic monitoring has been terminated by Technical <br />Revision No. 16 (TR -16) <br />H. Transfer of Wells <br />1. At this time, New Elk Coal Company, LLC has not requested a transfer of an <br />exploration or monitoring well. (4.05.14 (3)) <br />L Discharge of Water into an Underground Mine <br />No specific approvals are granted under this section. <br />Stream Buffer Zones <br />The Division originally approved surface mining activities within 100 feet of a <br />perennial stream or stream with a biological community. This decision was <br />based on a finding that the original stream channel will be restored, water <br />quality and quantity shall not be adversely affected, and appropriate riparian <br />vegetation will be reestablished. The buffer zone variance was granted for the <br />areas located along Lorencito Creek where the haul road, access road, or topsoil <br />piles are adjacent to the Lorencito stream channel. This approval is no longer <br />granted as the areas requiring protection have been bond released under Surety <br />Release No. 2 (SL -02). (4.05.18(1)) <br />16 <br />
