Mr. Travis Marshall <br />March 6, 2014 <br />Page 4 <br />tertiary controls consist of the upgradient berms and the stormwater control plan <br />diverting run on water around the mine portal area. The petroleum fuels will be <br />stored in a farm -style tank in a steel stock tank containment placed near the office <br />trailer, generator, and compressor near the proposed waste rock storage. The <br />blasting agent will be stored in the Bureau of Alcohol, Tobacco and Firearms <br />approved powder magazine outside of the mine portal area. The magazine is a <br />walk -in size storage building constructed of heavy steel armor plate. The magazine <br />is water tight and constructed on legs above the ground so any leakage would be <br />immediately observed. The blasting agent itself is a dry granular material with no <br />qualities to cause a release. <br />21. Rule 6.4.21(7)(f) - Liberty asserts that the containment facilities are of adequate size <br />to provide sufficient reserve capacity to prevent a release of uranium ore and other <br />designated chemicals. This is demonstrated in the Preliminary Drainage Report <br />enclosed Appendix A, as discussed in comment response 3 above. <br />22. Rule 6.4.21(8): This rule covers groundwater information. Appendix E provides the <br />requested hydrogeology information for the mine area. <br />23. Rule 6.4.21(9)a: Appendix E, in response to comment 22, also covers the potential <br />for future groundwater use within 2 miles down gradient of the proposed Liberty <br />Mine. <br />24. Rule 6.4.21(10)(a): The Environmental Protection Facilities consist of the drainage <br />design recommendations of the preliminary Drainage Report prepared by a <br />Professional Engineer is included with this response as Appendix A. The final, <br />Professional Engineer - certified drainage design plan including construction drawings <br />will be prepared contingent on permit approval and will be submitted for DRMS <br />approval prior to any construction work. <br />25. Rule 6.4.21(10)(a): The preliminary Drainage Report, enclosed as Appendix A, <br />provides the recommended proposed configuration of the detention ponds. Liberty <br />herein commits to providing as -built drawings of each of the ponds once they are <br />constructed. <br />26. Rule 6.4.21(10)(b): A Storm Water Management Plan (SWMP) for the Liberty Mine <br />is enclosed as Appendix A, as noted in response to comment 3. The SWMP <br />includes the required maintenance and inspection program. <br />27. Rule 6.4.21(11)(a) and (b): The Dolores River water quality standards and discussion <br />of surface water quality in the reach of the Dolores River closest to, and <br />topographically below the proposed Liberty Mine are attached in Appendix F . <br />28. Rule 6.4.21(12) and Rule 3.1.7: Appendix G contains the groundwater quality <br />monitoring plan. <br />29. Rule 6.4.21(13)(b)(i): Appendix H is a climatic data set which includes the wettest <br />year on record, 1973, for the proposed mine area. <br />
