A review of the records in the State Engineer's office has disclosed that there are existing <br /> wells or other water rights withdrawing ground water from the aquifer underlying the land <br /> claimed by the applicant. The well permit numbers, rates of withdrawal, and other relevant <br /> data concerning such rights are set forth in the attached Exhibit B. To prevent material injury <br /> to such vested water rights, the quantity of water underlying the land claimed by the applicant <br /> which is considered available for withdrawal has been reduced to 93.3 acre-feet. <br /> 11. The Cheyenne aquifer has been determined to be non tributary to the Arkansas River. <br /> Therefore, withdrawal of ground water from the Cheyenne aquifer underlying the applicant's <br /> land in Sections 22, 27, and 28, Twp. 22 South, Rng. 65 West will not, within 100 years, <br /> deplete the flow of a natural stream at an annual rate greater than one-tenth of one percent <br /> of the annual rate of withdrawal. <br /> Based on the above, the State Engineer finds that there is water available for withdrawal by <br /> the proposed well and no material injury to vested water rights would result from the issuance of <br /> the requested permit subject to the following conditions: <br /> a. The allowed average annual amount of water to be withdrawn from the aquifer by this <br /> well, well No. 4�a, 1 $- F , and all other wells constructed in the Cheyenne aquifer <br /> underlying the applicant's land shall not exceed 93.3 acre-feet (the quantity of water which <br /> is considered available divided by the 100 year aquifer life). <br /> b. The well shall be constructed no more than 200 feet from the location specified on the <br /> permit application. <br /> c. The applicant shall submit geophysical logs, which must include at a minimum an electric <br /> log, and lithologic logs after the construction of the well. The geophysical logs shall be <br /> o t_?ned from the hole before the casings are installed. <br /> d. The maximum pumping rate of the well shall not exceed 180 gallons per minute <br /> e. A totalizing flow meter must be installed on this well, well No. , <br /> and all other wells constructed in the Cheyenne aquifer underlying the applicant's land and <br /> maintained in good working order. Permanent records of all diversions must be maintained <br /> by the well owner (recorded at least annually) and submitted to the Division Engineer upon <br /> request. <br /> f. Production is limited to the Cheyenne aquifer. The well must be constructed with plain, <br /> non-perforated casing properly grouted so as to prevent intermingling of water bet'.veen <br /> aquifers. <br /> h. The owner shall mark the well in a conspicuous place with appropriate well permit <br /> numbers, name of the aquifer, and court case numbers. He shall take necessary means and <br /> precautions to preserve these marking. <br /> P.1-7 � � <br />
