r <br /> Memo to PCPC <br /> Re: SUP No. 1999-002 <br /> June 9, 1999 <br /> Page 2 <br /> LOCATION <br /> The property is located approximately 8 miles south of Pueblo and except for a small <br /> portion is east of Interstate 25. The mining and processing activity will take place <br /> initially easterly of the BNSF Railroad right-of-way (approximately 1.5 miles east of I- <br /> 25). The property is within portions of Sections 12, 13, 14, 18, 22, 23, 24, 25, 26, 27, <br /> 28, T22S, R65W and within portions of Sections 7, 18, 19, and 30, T22S, R64W of the <br /> 6'h PM (Exhibits 2 and 3). <br /> BACKGROUND <br /> A portion of the property was the subject of Special Use Permit No. 455 also for Mineral <br /> Extraction, Processing and Cement Manufacturing. Special Use Permit No. 455 was <br /> approved by the Pueblo County Planning Commission on November 24, 1981 with a <br /> single condition requiring a one year review. The applicant, Mineral Reserves, Inc., <br /> requested the special use permit upon approximately 3,900 acres of State Lands, which <br /> correspond to the boundaries being requested by the current applicant, except that the <br /> current applicant has extended the boundaries to include property northerly of the 1981 <br /> lands such that the permitted area would contain approximately 6,000 acres. In 1989, <br /> the Planning Commission approved a one-year review of Special Use Permit No. 455 <br /> with three conditions as follows: <br /> 1. The applicant shall provide the Department of Planning and Development with a <br /> copy of any present or future local, State or Federal permit applications, permits, <br /> amendments, or releases (e.g., MLRB, air quality, NPDES, Access, etc.) <br /> associated with Special Use Permit No. 455, within 30 days of their submittal or <br /> approval. <br /> 2. The applicant shall provide to the Department of Planning and Development a <br /> copy of the renewed lease within 60 days of this April 25, 1989 approval. <br /> 3. Special Use Permit No. 455 shall be placed on a 1-year review. <br /> On 4-24-90, a letter from Mineral Reserves, Inc., requested the special use permit be <br /> withdrawn. No activity had taken place up to that point and no permits had been <br /> acquired by the company to initiate the requested activities. <br /> The property was zoned A-1, Agricultural (minimum 40 acres) Zone District on January <br /> 6, 1967 with the adoption of amendment to the Pueblo County Zoning Resolution.
