Memo to PCPC <br /> Re: SUP No. 1999-002 <br /> June 9, 1999 <br /> Page 14 <br /> The plant shall comply with State, federal and local air quality regulations and <br /> requirements. <br /> AIR QUALITY <br /> An Air Quality Construction Permit and an Operations Permit will be necessary for <br /> construction of the facility and the mining operation and manufacturing and processing <br /> equipment. The Colorado Department of Public Health and Environment (CDPH&E) <br /> reviews and authorizes Air Quality Permits. <br /> FLOODPLAIN <br /> A portion of the property appears to be within the 100-year floodplain as depicted on <br /> Federal Emergency Management Agency (FEMA) Flood Insurance Rate Map, <br /> Community Panel No. 080147 365 B, dated September 29, 1989. A FEMA National <br /> Flood Insurance Program Flood Hazard Development Permit is required for any <br /> "activity"which falls within the flood zone, regardless of mitigation measures. <br /> CLEAN WATER ACT— SECTION 404 <br /> Waters of the United States are regulated under provisions of Section 404 of the Clean <br /> Water Act and a Department of the Army permit may be required for the discharge of <br /> dredged or fill material into these waters. The Department of the Army, Albuquerque <br /> District, Corps of Engineers, Operations Division — Regulatory Branch reviewed the <br /> project and comments, dated March 4, 1999, are attached as Exhibit 6. It appears that <br /> the development site contains the following water(s) of the United States: St. Charles <br /> River and its unnamed tributaries and multiple unnamed tributaries of Edson Arroyo. <br /> From the project description provided, the Corps comments that the following structures <br /> or activities may involve regulated discharges into waters of the US: road crossings of <br /> waterways, railroad crossings of waterways, mining activities, and building structures. <br /> STORMWATER DISCHARGE PERMIT <br /> Under the Colorado Water Quality Control Act, a Colorado Stormwater Discharge <br /> Permit will be required for the construction and operation of the facility. The CDPH&E <br /> reviews and authorizes Discharge Permits. <br />
