Gloria Z Pit SWSP <br />February 18, 2014 <br />Page 4 of 5 <br />this SWSP will not be made absolute by a water court action by the SWSP expiration date, a <br />renewal request must be submitted to this office with the statutory fee (currently $257) no later <br />than August 1, 2014. <br />2. Well permit no. 77305 -F was obtained for the current use and exposed water surface area of the <br />gravel pit in accordance with § 37 -90- 137(2) and (11), C.R.S. <br />3. The total surface area of the groundwater exposed at the Gloria Z Pit must not exceed 1.29 <br />acres, which results in a maximum evaporative annual loss at the Gloria Z Pit of 2.69 acre -feet. <br />4. The annual water used for dust control at the Gloria Z Pit shall not exceed 0.39 acre -feet, the <br />total product mined at the Gloria Z Pit site shall not exceed 20,000 tons per year, which results in <br />0.59 acre -feet of water lost with the mined aggregate, and 0.35 acre -feet for processing. <br />5. All pumping for dust control and /or processing shall be measured in a manner acceptable to the <br />division engineer. <br />6. Total consumption at the Gloria Z Pit must not exceed these aforementioned amounts unless an <br />amendment is made to this SWSP. <br />7. Approval of this SWSP is for the purposes as stated herein. Any additional uses for which the <br />water may be used must first be approved by this office. Any future additional historical <br />consumptive use credit given (e.g. agricultural water transfer) for this site must consider all <br />previous credits given. <br />8. Applicant shall replace the net evaporative depletions from the exposed ground water surface <br />area that may occur during the assumed ice covered period (December, January and February) <br />for any time that the exposed ground water in the pit is not completely covered by ice. <br />9. The replacement water, which is the subject of this SWSP, cannot be sold or leased to any other <br />entity. As a condition of subsequent renewals of this SWSP, the replacement water must be <br />appurtenant to this site until a plan for augmentation is obtained. All replacement water must be <br />concurrent with depletions in quantity, timing and locations. <br />10. To assure that depletions from ground water evaporation do not occur in the unforeseen event, <br />or events, that would lead to the abandonment of the pit, the Applicant has obtained a bond in <br />the amount of $78,218, which includes the cost of backfilling the ponds. <br />11. All releases of replacement water must be sufficient to cover all out -of- priority depletions in time, <br />place, and amount and must be made under the direction and /or the approval of the water <br />commissioner. The release of replacement water may be aggregated to maximize beneficial <br />use. The water commissioner and /or the division engineer shall determine the rate and timing of <br />an aggregated release. <br />12. The name, address and phone number of the contact person who will be responsible for the <br />operation and accounting of this plan must be provided with the accounting form to the division <br />engineer and water commissioner. <br />13. Adequate accounting of depletions and replacements must be provided to the division <br />engineer in Greeley (Div1Accounting(a-state.co.us) and the water commissioner (Garver <br />Brown at Garver. Brown(c_state.co.us) on a monthly basis. All amounts shall be in acre -feet. <br />All submitted accounting must conform to the Administration Protocol "Augmentation Plan <br />Accounting — Division One, South Platte River" (attached). <br />14. This SWSP may be revoked or modified at any time should it be determined that injury to other <br />vested water rights has or will occur as a result of this SWSP. Should this SWSP expire without <br />renewal or be revoked prior to adjudication of a permanent plan for augmentation, all excavation <br />
