Memo <br />Date: 6June 11 <br />From: R.L. Gubka <br />To: File <br />Conversation between Ward Burbridge and Ross Gubka Concerning his Irrigation Water <br />and Depressions in his Fields <br />First Item of Discussion. <br />Ward feels that he owns the original irrigation ditch right -of -way through the <br />WFC /Garvey property and through his property and should have been asked before the <br />WFC - Burbridge pipeline was installed in 2008. This raises a title issue that WFC will <br />review. <br />We next discussed irrigation water flowing to the property. Irrigation water coming <br />down hill along WFC /Garvey east property line to his valve would have pressure, <br />although Ward felt that he would lose too much pressure /water - quantity when the <br />pipeline turned back westward and to the high point of his land. I tried to assure him that <br />there was enough fall to deliver his shares of CCC to the high point on his property. I <br />also said that WFC was waiting for the day so when we got bond release and the siderolls <br />and aluminum mainline pipe were removed, that we would then extend the pipeline from <br />his northeastern property corner westward to the high point on his property. At this time <br />there was too much irrigation equipment on the ground to run the underground pipeline. <br />I also mentioned that once WFC extended the pipeline to his highest point, that we would <br />gladly cut him ditches to where ever he wanted them on his land. <br />I asked Ward if he had decided on what kind of irrigation system they wanted. I asked if <br />they wanted gated pipe /furrows or the sideroll method. I mentioned that an earlier <br />discussion with Buckshot indicated that the Burbridges may want to purchase the <br />siderolls from WFC. I mentioned that I asked Buckshot to research what siderolls cost <br />and for him to give us a quote. Buckshot has never gotten back to me. Ward said they <br />hadn't made up their mind yet on what to do. <br />Second Item of Discussion. <br />Ward asked again about what WFC was going to do about `sink holes'. I told Ward that <br />if water pooled up in a depression that we would fix it. If the water had positive flow <br />through the depressions without pooling, then we wouldn't. The background to this is <br />that this property has already achieved Phase II bond release. Ward's claims regarding <br />"sinkholes" were already inspected by DRMS as part of this process, and were found to <br />100056831.2 1 <br />
