3 <br />i <br />7 <br />7 <br />1 <br />50 <br />1 We have come before you at no fault <br />2 of ours. We are just farmers, and as farmers we <br />3 depended solely on the mine -- on the mine to <br />4 present information that was accurate to the <br />5 division and for the division to know the rules and <br />6 regulations governing prime farmlands as they would <br />7 enforce those rules and regulations protecting the <br />8 landowner and the landowner rights and the <br />9 properties of the landowner as specified in the <br />10 act. <br />11 We were guaranteed that the land <br />12 would be returned to as good as or better than it <br />13 was, and we will not accept anything less than what <br />14 we had. PR 06 does not provide us with these <br />15 conditions. <br />16 Section 4.15.11 states that all areas <br />17 affected by surface coal mining operations shall be <br />18 restored in a timely manner. The land must be <br />19 restored to conditions that are capable of <br />20 supporting the uses which they were capable of <br />21 supporting before any mining to higher or better use <br />22 achievable, and PR 06 does not do this. <br />23 It has been a misconception that if <br />24 you have a lease, you are protected. This is not <br />25 true. A lease is just a right of entry. <br />
