OPERATORS <br />SHOULD READ THE FOLLOWING PAGES CAREFULLY IN ORDER TO ASSURE COMPLIANCE <br />WITH THE TERMS OF THE PERMIT AND APPLICABLE RULES AND REGULATIONS. If a <br />Possible Violation is indicated, you will be notified under separate cover as to when the Mined Land <br />Reclamation Board will consider possible enforcement action. <br />INSPECTION TOPIC: Hydrologic Balance <br />PROBLEM /POSSIBLE VIOLATION: Problem: The following problem was cited during the July 22, 2010 inspection, <br />There is impounded water at the site that appears to be exposed ground water. This represents a problem with <br />respect to 34.32.5- 116(4)(h) C.R.S. for failure to minimize disturbance to the prevailing hydrologic balance of the <br />affected lands during mining. <br />CORRECTIVE ACTIONS: The Operator did not respond by the original due date to provide verification that one <br />the four mitigative options, described in the April 30, 2010 letter has been implemented in accordance with <br />State Engineer requirements to address the problem of exposed ground water, or submit evidence that the <br />impounded water is not ground water. The Operator will be required to address this outstanding problem by <br />the due date listed below. <br />CORRECTIVE ACTION DUE DATE: 5/05/14 <br />OBSERVATIONS <br />The Church Pit was inspected by Peter Hays with the Division of Reclamation, Mining and Safety as part of the <br />Division's monitoring inspection program. The site was previously inspected by the Division on July 22, 2010. <br />Mr. Thomas Murray with Lakewood Brick and Tile Company and Mr. Steve O'Brian with Environment, Inc. <br />were present during the inspection. <br />Page 1 of 4 <br />
