In conclusion to the assumption of subsidence to Well 119459, review of the dates at the
faces of the other panels in the area shown on Illustration I indicate that there was no mining
occurring in that area during 1991. Mining operations were in other sections of the mine at that
time.
In Dr. Corley's email to Janet Binns (12 -7 -12, copy enclosed) he also complains of water
being pumped from the North Well (a.k.a. MW -NW) during the time period at issue and
assumed hydrologic alterations occurred to the North Well. The North Well is located
approximately 1,380 feet south, southeast of Well No. 119459. The North Well was taken out of
service and ceased dewatering the mine section during 1994 due to the Kansas /Arkansas River
Dispute and the resulting denial of the well permit application. Accordingly, the mine dewatering
operation was then changed to a closed circuit dewatering system wherein mine water was
pumped to lower sections of the mine that had been mined out.
EFCI applied for a well permit (subsequently denied) for the North Well during 1994.
Although Dr. Corley complains of the pumping from the North Well, records disclose an
Affidavit (copy enclosed) signed by Dr. Corley, dated February 15, 1994, wherein Corley waives
any objection or concerns that permitting the North Well may materially affect Corley wells or
water rights.
Considering the above findings, the logical conclusion for the loss of water in the low
producing well, (1 gallon per minute) Well 119459, was more likely due to a limited water
supply from a perched water table or some other like source.
If you have any questions or need additional information please contact me.
Sincerely,
eorge V Patterson
Energy Fuels Coal, Inc.
Cc: Rich Munson — EFCI
David Berry - DRMS
Enclosures: Illustration 1, Corley Company Well No. 119459 Location Map;
Copy of W D Corley, Jr. email to Janet Binns dated 12 -7 -12;
State of Colorado Affidavit, receipt no. 324371, The Corley Company.
