of the remaining 1,766.39 disturbed area acres (1,697.6 interim program and permanent <br />program lands and 68.79 pre -law lands; Table 2, third column). The Peabody Sage Creek Mine <br />disturbed area acreage of 1,766.39 acres does not include the approved 67.0 disturbed area acres <br />previously undisturbed by the Seneca II Mine. <br />When the Peabody Sage Creek Mine Permit was issued, the Division at that time determined the <br />approved disturbed area was 2076.70 acres. This was composed of (1) the 1766.39 disturbed <br />area acres transferred from the Seneca II Permit; (2) 52.60 acres of newly proposed disturbed <br />area; and (3) 257.71 acres of disturbed lands that had been previously granted Phase III release <br />while within the Seneca II Permit (Table 3, first column). During the Division's 2013 midterm <br />review of the Peabody Sage Creek Mine permit, it was determined that 178.15 acres of the <br />257.71 disturbed area acres that had been previously been Phase III released should not have <br />been re- permitted. This discrepancy was corrected with Minor Revision No. 13. Subsequent to <br />the issuance of the Peabody Sage Creek Mine Permit, an additional 14.25 disturbed area acres <br />were approved to be disturbed via various revisions.
