2.04.12; Prime Farmland Investigation <br />18. Rule 2.04.12 indicates that the applicant shall conduct a pre - application investigation of the <br />proposed permit area to determine whether land within the area may be prime farmland. Was a pre - <br />application investigation completed for the expansion area? If not, please conduct a prime farmland <br />investigation for the expansion area. <br />Trapper Response to Comment 18: Trapper utilized the NRCS Web Soil Survey to investigate prime <br />farmland soil types and distribution. No prime farmland is contained within the proposed expansion area. <br />Specific soil types as noted by the NRCS to be eligible for prime farmland are not present. The current <br />permit discussion is applicable to the expansion area. <br />1.3.1.1 Lands Controlled by Trapper Minine: <br />19. Rule 2.03.6(]) requires that each application contain a description of the documents upon which the <br />applicant bases his or her legal right to enter and begin surface coal mining operations in the permit <br />area, and a statement as to whether that right is the subject of pending litigation. A review of the <br />warranty deeds and surface leases in section 1.3.1.1 of the permit was conducted. It does not appear <br />a description of the documentation the applicant has to legally enter all of the lands in the expansion <br />area has been submitted. It does not appear all of the expansion area in Section 33 of Township 5 <br />North and 90 West is covered under the warranty deed. It is unknown if the lots described in the <br />warranty deed for Sections 4 and 8 of Township 5 North and Range 90 West cover the expansion <br />permit area. The expansion area in section 9 of Township 5 North and 90 West does not appear to <br />be covered in any of the descriptions in section 1.3.1.1 in the permit. Please update this permit <br />section accordingly. <br />Trapper Response to Comment 19: Warranty deed information for the new areas included in the permit <br />expansion area is added. Enclosed permit page 1 -25 is revised and new pages 1 -25a through 1 -25c <br />(enclosed) are added to accommodate the new legal descriptions. In addition, enclosed Table of Contents <br />page i -1 is revised to incorporate the new pages added to Section 1.3.1.1. <br />3.3.3 East Panel Landslide Geotechnical Evaluation <br />20. On page 3 -27b, Stations 5 to 8 have replaced Stations 1 to 4 that were listed previously. For the <br />purposes of continuity, a new paragraph should be inserted at the top of page 3 -27b which gives a <br />brief description of what happened to the original four stations, and when the current stations were <br />placed in service. <br />Trapper Response to Comment 20: Information has been added to enclosed page 3 -27b addressing site <br />installation dates, equipment installed at each monitoring station, and removal dates for individual stations. <br />In addition, Figure 3.3.3 -1 (enclosed page 3 -27c) has been updated to reflect current station locations and <br />Table 3.3 -4 (enclosed page 3 -27d) is updated to reflect current active locations. Enclosed page 3 -27a is <br />revised to correct a typo. <br />
