(1) Comprehensive General Liability and Property Damage <br />Insurance in the amount of One Million Dollars ($1,000,000.00) combined single limit; <br />(2) Employer's Liability Insurance in the amount of One Hundred <br />Thousand Dollars ($100,000.00) each occurrence; <br />(3) Automobile Liability Insurance in the amount of One Million <br />Dollars ($1,000,000.00) combined single limit; and <br />(4) Adequate and reasonable insurance for other risks ordinarily <br />insured against in similar operations. <br />8. Taxes. Lessee shall pay all personal and real property taxes assessed against <br />machinery, tools, equipment, supplies, buildings and stockpiles of Materials placed by <br />Lessee on the Leased Property. Lessor shall pay all other real property taxes on the <br />Leased Property and on any improvements thereon, including, without limitation, the <br />improvements that Lessor installs on the Leased Property for Lessor's own purposes. <br />9. Labor and Materials. Lessee shall defend, indemnify and hold harmless <br />Lessor from and against any and all claims, charges, demands, causes of action, damages <br />and liability, including reasonable attorneys' fees and expert fees, that arise from or are <br />connected to the acts or omissions of Lessee hereunder or to those of its contractors, <br />subcontractors, employees, officers, agents or lessees in regard to providing labor and <br />acquiring or installing materials, equipment and supplies for operations under this Lease. <br />Lessee further agrees to keep the Leased Property free and clear of liens, charges, claims <br />or demands arising from Lessee's operations hereunder and to promptly pay for all labor <br />performed on the Leased Property and for all supplies, materials, and equipment used or <br />placed on the Leased Property. Lessee may contest in good faith any lien; provided that, <br />Lessee shall not allow title to the Leased Property or any portion of it to be lost. <br />10. Termination. <br />A. Lessor shall have the right at Lessor's option to terminate this Lease <br />if Lessee fails to perform any of its obligations hereunder as follows: <br />(1) If Lessee fails to pay when due any amounts to be paid <br />hereunder, Lessor may at Lessor's option give Lessee written notice of such failure and <br />Lessee shall have fifteen (15) days from the date it receives notice to pay the amounts <br />owed to Lessor. If Lessee fails to pay the past due amounts to Lessor within the fifteen <br />(15) day period, Lessor may at Lessor's option declare Lessee in default and terminate this <br />Lease. <br />(2) If Lessee defaults in the performance of any obligation <br />hereunder other than the obligation to pay money when due, Lessor may at Lessor's <br />(12/06/13) <br />5 <br />
