C //l \ I I Y`� <br />January 2, 2014 <br />Tim Cazier <br />Division of Reclamation Mining and Safety <br />1313 Sherman Street, Room 215 b <br />Denver, Colorado 80203 RECEIVED <br />RE: Evans #2 Pit M-2000-041r/ JAN 0 d 4 <br />Response to Adequacy of October 7, 2013 <br />DIVISION OF <br />Dear Mr. Cazier, MINING AND 64 i'y <br />Please accept the following explanations and exhibits in response to Division comments of <br />October 7, 2013. <br />6.4.3 Exhibit C: Pre - mining and Mining Plan Maps <br />Item 1: Adjoining surface owners of recorded are labeled on map. <br />Item 2: Topography is delineated. <br />Item 3: On May 31, 2013, Mark McLean of Deere & Ault Consultants Inc. submitted an <br />amendment to Colorado Division of Water Resources requesting increase of <br />surface water exposure to 8 acres. Consistent with current operations, ASI, the <br />reservoir construction contractor, performs project surveys, delineating exposed <br />water surface. Fremont Paving & Redi -Mix Inc. (Fremont) adjusts dewatering <br />trench and collection areas as necessary to maintain compliance with the <br />approved SWSP. <br />Item 4: Consistent parcel labeling is provided on all maps. <br />Item 5: The map exhibit legends include all delineations. <br />Item 6: The overhead electrical power line is a service line owned by Fremont. <br />Stonewall Springs Quarry LLC (SSQ) owns the Excelsior Ditch lateral and <br />fences. Ownership is notated and included in Exhibit S: Permanent Man -Made <br />Structures. <br />6.4.4 Exhibit D: Mining Plan <br />Item 7: Material is mined with front -end loaders and transported to the processing plant <br />by truck or overland conveyor. <br />Item 8: Consistent with current operations, ASI, the reservoir construction contractor, <br />performs surveys, delineating area disturbed and use including production area, <br />interim reclamation area and final reclamation area. The maximum disturbed <br />area will change with project demands to achieve final reclamation in cooperation <br />with Colorado Parks and Wildlife (CPW). As the project proceeds, ASI will <br />perform surveys of disturbed areas.
