Pineda <br />GCC Energy, LLC <br />Director <br />6473 County Road 120 <br />Hesperus, CO 81326 <br />Re: King Coal Mine — Permit No. C- 1981 -035 <br />Review of 2012 Annual Reclamation Report <br />Dear Mr. Bird: <br />The Division has conducted a review of the Annual Reclamation Report (ARR) submitted for <br />calendar year 2012 at the King Coal Mine. The ARR has been evaluated with respect to the <br />requirements set forth in Rule 2.04.13 and commitments made by GCC in Section 2.04.13 of the <br />permit. We have also compared the 2011 ARR with reports submitted in previous years. <br />Because the King Coal Mine consists of two geographically separate surface facility areas (King <br />I and King II), a separate CDRMS ARR form has been routinely submitted for each site. King I <br />was in operation prior to SMCRA; ARRs for this mine date back to 1991. The King II area was <br />permitted in 2006, under PR -8. Underground mining operations at King I drew to a close in <br />2007, and development shifted to King IL <br />Rule 2.04.13 requires that an ARR be filed by February 15 for the previous calendar year, or <br />other such date as agreed on. Section 2.04.13 of the permit supersedes this requirement, with a <br />date of March 1. <br />The 2012 ARR was received via Email on April 5, 2013. In future years, Tease ensure that <br />the report is submitted by March 1, as required. <br />Rule 2.04.13 states that the ARR shall include, but not be limited to, text, discussion and maps. <br />Maps of the King I and King II disturbed areas accompanied the ARR forms. As with 2011, <br />maps have been provided.
