PERMIT #: M -1988 -108 <br />INSPECTOR'S INITIALS: PSH <br />INSPECTION DATE: November 21, 2013 <br />Hydrologic Balance: <br />The Operator stated the stormwater captured in the pit was used for material processing. The Division does <br />not have evidence this use of stormwater is allowed by the Office of the State Engineer (SEO). The Operator <br />stated the landowner has the required water rights for the industrial water use. As cited as a problem on the <br />first page, the Operator must submit documentation from the SEO demonstrating the approved water use by <br />the corrective action date. <br />Records: <br />The Western Aggregate site is permitted for 181.17 acres. The site was originally permitted for 108.04 in <br />1988. In 2004, the Operator submitted an amendment application (AM -02), adding 75 acres to the permit for <br />the manufacturing of Realite Plus product. In 2008, 1.8334 acres were released from the permit acreage <br />under AR -01 to provide an easement for a future City of Boulder Open Space walking trail. The resulting total <br />permit acreage should be 181.21 acres, not 181.17, which is a result of the original permit acreage being <br />entered as 108.0 acres instead of 108.4 acres. The Division will correct the permit acreage in the Division's <br />permit system as a result of this inspection. <br />As cited as a problem on the first page of this inspection report, the Operator stated they were not aware of <br />the 2004 amendment and the associated acreage increase. The Operator considers the permit boundary to be <br />the original mine site located west of the Hwy 93 minus the acreage released for the walking trail easement. <br />The Operator must clarify the permit boundary and submit proof to the Division by the corrective action date. <br />Copies of the first page of the original application, original location map, first page of amendment application, <br />legal description, location map and introduction page for the amendment application are attached for <br />reference. <br />Signs and Markers: <br />As cited as a problem requiring corrective action by the Operator on the first page, the mine sign posted off of <br />Highway 93 indicates Western Aggregates as the Operator not TRNLWB, LLC. The Operator must update the <br />sign and submit photographic documentation to the Division by the corrective action due date. The boundary <br />of the mining area located west of Hwy 93 was delineated by fence on all sides as required by Rule 3.1.12.
