PERMIT #: M -1988 -108 <br />INSPECTOR'S INITIALS: PSH <br />INSPECTION DATE: November 21, 2013 <br />INSPECTION TOPIC: Signs & Markers <br />PROBLEM /POSSIBLE VIOLATION: Problem: The mine identification sign does not indicate TRNLWB, LLC as the <br />Operator. This is a problem for failure to post a mine identification sign as required by Section 3.1.12(1) of the <br />Rule. <br />CORRECTIVE ACTIONS: The Operator shall, at the entrance of the mine site, post a sign which shall be clearly <br />visible from the access road with the following: the name of the Operator, a statement that a reclamation <br />permit for the operation has been issued by the Colorado Mined Land Reclamation Board and the permit <br />number. The Operator shall submit photo documentation a proper sign has been posted by the corrective <br />action date. <br />CORRECTIVE ACTION DUE DATE: 1/19/14 <br />OBSERVATIONS <br />The Western Aggregates site was inspected by Peter Hays with the Division of Reclamation, Mining and Safety <br />(Division) as required by the Transfer of Permit and Succession of Operators process and Rule 1.12. Mr. Gary <br />Feiner and Mr. Matthew Hallmark with Trinity Industries, Inc. were present during the inspection. The site was <br />previously inspected by the Division on January 31, 2012. <br />On October 2, 2013, the Division approved the Transfer of Permit and Succession of Operators Application <br />Form (SO -02) from TXI Operations LP dba Western Aggregates to TRNLWB, LLC. TRNLWB, LLC choose to not <br />waive their right to a 30 -day processing period and was required to submit a replacement Financial Warranty <br />for the same dollar amount maintained by the former Operator ($464,162.00). TRNLWB, LLC is now the <br />permitted Operator of the Western Aggregates site and TXI Operations LP has been released from reclamation <br />responsibility at the site. <br />Financial Warranty: <br />The Division is required to recalculate the reclamation bond within 60 -days from the date the permit transfer <br />is completed. The Division currently holds a reclamation bond in the amount of $464,162.00. The bond <br />amount was calculated to be adequate to perform reclamation at the site based on this inspection. TRNLWB, <br />LLC will not be required to post additional financial warranty at this time. <br />Gen. Compliance With Mine Plan: <br />The Western Aggregates site was active during this inspection. A hydraulic excavator was observed removing <br />shale from the pit. The material was transported by a haul truck to a conveyor for processing at the plant. <br />Due to the recent flood event in the area, the pit was flooded at the time of the inspection. Mining activity <br />has been relocated to the southeastern corner of the pit above the floor water elevation while the pit is <br />dewatered. Mining would resume in the pit floor after the pit is dewatered which will take months to achieve. <br />The southern stormwater containment berm in the northern portion of the site was breached during the <br />flooding. A dewatering pump was observed in the northern end of the pit. The 2013 Annual Report submitted <br />by TRNLWB, LLC accurately depicted the current mining related disturbance and state of reclamation at the <br />site. <br />Page 2 of 5 <br />
