Engineering and Surveying. In accordance with 2.03.4(2)(b), please provide updated
information regarding the resident agent for the Carbon Junction Mine.
8. DRMS 12/18: The last paragraph of subsection 2.03.5 says that no enforcement actions
have been issued to Oakridge in the three years prior to submission of the RN -04
application. While this is true, the Division believes that given the amount of time that
has elapsed in response and review of the RN -04 application, it is appropriate to modify
this section to include CV -2013 -005. Please revise the APIs to include the information
required by 2.03.5(3) for the subject NOV.
2.05.3 — Operation Plan -- Permit Area
1, DRMS 04/19: In Section 2.05.3(4) of the APD, the second paragraph directs the reader
to "Exhibit N of Appendix 2.05" for the sediment control plan. There does not appear to
be a corresponding exhibit or appendix within the current permit. Similar direction
( "Exhibit P, Appendix 2.05 ") is provided near the end of the first full paragraph on Page
5 -5. Please correct these references to direct the reader to the appropriate location within
the permit.
DRMS 12118: The two locations noted were revised, as requested. The Division has
subsequently identified a number of other mis- directing and obsolete references in the
APD. These have been individually identified, together with their corrections, and are
enclosed with this letter. Please revise the text of the abridged permit document to
direct the reader to the appropriate locations referenced
2. DRMS 04/19: At the bottom of page 5 -3, please direct the reader to the portion of the
permit where the approved designs for the Carbon Junction Canyon permanent diversion
may be found.
DRMS 12/18: The text was not added, as requested. However, in partial abatement of
Notice of Violation CV -2013 -005, as -built plans for the permanent diversion were
incorporated into the permit with the approval of TR -17 in Oct -2013. Please add a
reference in this section to new Appendix 5 -12.
3. DRMS 12/18: The last paragraph of subsection 2.05.3(3) addresses roads that will be
retained as permanent features. Please expand this list to include the Light Use Road
built to access well 510. (A letter from Oakridge, requesting retention of this road, was
provided with the adequacy response.)
4. DRMS 12/18: Designs for the reestablishment of the Upper Carbon Junction Channel
were approved under TR -17 on 29 -Oct -2013. The work was accomplished during
November 2013, completing abatement of CV- 2013 -005. Please update the Stream
Channel Reconstruction section of 2.05.3(4) to include this work and a reference to
Appendix 512, where the designs may be found
