to comply with Rule 4.05.9(13)(d) for sediment ponds 006, 016 and 017. Also, SCC has not <br />supplied a permanent impoundment demonstration, landowner approval letters or SEO <br />documentation for stock pond T -22. Given this, sediment ponds 006, 016 and 017 as well as <br />stock pond T -22 will be excluded from approval of SL -4. <br />All of the impoundments were inspected during the June 4, 2013 bond release inspection. <br />Multiple Exhibits in Tab 13 of the permit include designs and as -built plans for each of these <br />impoundments and any necessary impoundment certifications. During the bond release <br />inspection and the May 14 and 15, 2013 site inspection the Division checked the general <br />configuration of each of the impoundments to determine if they have been constructed in <br />accordance with the permit. This included, measuring the embankment top width and the angle <br />of the embankment face. Also, the embankment was checked for signs of erosion, weaknesses <br />and failures. The Division also took measurements of the primary and emergency spillway <br />features to determine if they were in accordance with the approved plan. Observations were <br />made of the overall appearance of the functionality of the impoundments. Please see the above <br />cited inspection report for details of the Divisions findings. Each of the impoundments appeared <br />to have been constructed in accordance with the permit requirement and appeared to be <br />functioning as designed. <br />SL -3 Exclusion Areas Reassessed <br />Channel PM 4 -D <br />As indicated above, this channel was removed from the bond release request area due to a gully <br />that will need to be repaired within the channel. <br />Channel PM -21) <br />The Division proposes to approve Phase I bond release for this channel. <br />Summary and Conclusions <br />The Division has completed its review and evaluation of the SL -4 Phase I bond release request <br />submitted by SCC for the Seneca II -W Mine.
