OTHER PERMITS AND LICENSES REQUIRED EXHIBIT M <br />The following permits are needed for the site: <br />1. Gunnison County Land Use Permit - Major Impact — A land use permit has been applied <br />for, has been approved by the local Planning Commission, and is awaiting final approval <br />by the Gunnison County Board of County Commissioners. <br />2. CDPHE Discharge Permit - A stormwater /process water discharge permit will be needed <br />for this operation. <br />3. APEN — A fugitive air emissions permit is needed from the Colorado Department of <br />Public Health and Environment since the site will mine more than 70,000 tons per year. <br />Air emissions permits will be in place for all portable equipment utilized on site which <br />requires a permit. <br />4. A Colorado Department of Transportation Access Permit is in place for the access to <br />Highway 50. <br />5. A Spill Prevention Control and Countermeasure (SPCC) Plan will be needed at this site <br />to cover the storage and transport of fuel and other liquids that are regulated by the EPA. <br />6. A gravel well permit with the Colorado Division of Water Resources. <br />Tomichi Pit, December 2013 M -1 <br />
