3.2. Licensee shall restrict construction equipment height under the transmission line to <br />fourteen feet. Licensee shall not leave its equipment parked in the Easement. <br />3.3. Licensee shall ensure that all workers in proximity of the energized line(s) are qualified. <br />"Qualified" is defined in O.S.H.A. 29 CFR 1910.269, latest edition and all applicable <br />M.S.H.A. regulations. <br />3.4. Licensee agrees to preserve an undisturbed radius of no less than one hundred feet from <br />the structure foundations (footers and /or guy anchors of Licensor's transmission line). <br />Any slope created outside the edge of the 100 foot undisturbed radius must conform to <br />a three to one ratio to allow for access of Licensor's maintenance equipment. <br />3.5. If directed by Licensor or designated representative of the Licensor the Licensee shall <br />provide any shoring or other supporting devices to protect the foundation of the <br />Licensor structure(s) at the cost of License. <br />3.6. Licensee agrees not to place any material piles within the transmission right -of -way. <br />3.7. Licensee agrees to construct any ramps or roads, to Licensor's reasonable <br />specifications, as shall be reasonably appropriate for Licensor to access pole locations <br />in the mining area. <br />3.8. Licensee agrees to notify Licensor within 60 days after mining operations cease and <br />reclamation is complete. Licensor shall have 60 days after receipt of the notice to <br />inspect and determine if reclamation is satisfactory. <br />4. This License is issued subject to any prior licenses or leases granted by the Licensor for <br />facilities of other parties. <br />5. Licensor reserves the right to license others to install pipes, conduits or ducts in, on, under <br />and along the premises herein described, provided that same shall not interfere unreasonably <br />with the license herein granted. <br />6. After initial mining and thereafter, in the event of resettling, Licensee shall restore the <br />surface of the mined area in Licensor's Easement by grading and compacting any <br />irregularities left after mining operations and shall reclaim all disturbed areas. <br />7. Unless extended, Licensee is hereby granted 2 years from the date of execution by Licensor <br />to initiate and complete reclamation and mining activities as described in Exhibit A. <br />Failure to do so, or to obtain an extension for construction from Licensor, shall cause this <br />license to be revoked thereby terminating any right of interference with Licensor's Easement <br />and causing Licensee to remove facilities pursuant to paragraph 12 herein. <br />8. Protective measures which may be taken by Licensee shall in no way damage facilities of <br />Licensor, and if such damage occurs, Licensee shall take immediate steps to correct the <br />
