Mr. Chris Gilbreath <br />December 5, 2013 <br />Page 2 <br />compliance for any coal operation which, in the judgment of the Division, has the <br />potential to negatively impact the quality of groundwater for which quality standards <br />have been established by the Water Quality Control Commission. Specific points of <br />compliance are established after consultation with the Division of Water Resources to <br />determine the effects of surface mining activities on the quantity and quality of water in <br />groundwater systems in the permit area and adjacent areas. Analytical data for the new <br />nested set of wells were just recently submitted with TR -05 and the Division has not had <br />the opportunity to fully review these data along with other geohydrological information <br />to determine the potential for negative impacts to groundwater within and adjacent to the <br />NHN permit area. Since this analysis has not been fully completed in accordance with <br />4.05.13 it is premature to select points of compliance. Please remove all reference in the <br />revised permit text submitted with TR -05 that refers to (GW -N56, GWN -57, and GW- <br />N58) as the points of compliance for the NHN Mine. It would be appropriate to revert <br />back to the original permit text prior to TR -05 regarding the points of compliance <br />discussions. <br />Please feel free to call me if you have any questions.
