Box 33695 <br />Denver, CO 80233 -0695 <br />Re: New Horizon North Mine, Permit No. C- 2010 -089 <br />Technical Revision No. 5 (TR -05) Preliminary Adequacy Review <br />Dear Mr. Gilbreath: <br />The Colorado Division of Reclamation, Mining and Safety (Division) has reviewed Western <br />Fuels- Colorado (WFC's) TR -05 application for the New Horizon North Mine (NHN). TR -05 <br />was submitted to address installation of ground water monitoring wells GW -N56, GW -57, and <br />GW -N58 and for proposed modifications to the mine facilities and haul road construction and <br />compaction. The Division has the following adequacy review comments regarding the new <br />groundwater monitoring wells and the changes proposed for Section 2.04.7 of the permit <br />application package. We are still in the process of reviewing the proposed changes to Section <br />2.05.3(3) regarding mine facilities and haul road construction and compaction. We will forward <br />those comments to you as soon as we have completed our final review. <br />The statement "Appendix 2.05.6(3) -4 contains State Engineer approved well permits for <br />the New Horizon North Mine" has been deleted from the text on page 4 of Section <br />2.05.6(3). This statement should remain in the permit text because it is still relevant. <br />Appendix 2.05.6(3) -4 contains two parts (a) Approved Well Permits Backfill Dewatering <br />Wells and (b) Active Mining Pit Dewatering "Well ". A third part to this appendix should <br />be added for the twelve (12) active NHN monitoring wells since SEO well permits <br />are required for these. Please retain the reference to Appendix 2.05.6(3) -4 on page 4 of <br />Section 2.05.6(3) and add Appendix 2.05.6(3) -4c Approved Well Permits Groundwater <br />Monitoring Wells. <br />2. During our initial review and permitting for the NHN Mine, the Division indicated that <br />the new set of nested wells (GW -N56, GW -N57, and GW -N58) would potentially <br />function as the points of compliance for the NHN Mine since they are located down <br />hydraulic gradient from the affected area. Rule 4.05.13 requires one or more points of <br />Office of Office of <br />Mined Land Reclamation Denver • Grand Junction • Durango Active and Inactive Mines <br />
