c. where such structure is a utility, the Applicant may supply a notarized <br />letter, on utility letterhead, from the owner(s) of the utility that the <br />mining and reclamation activities, as proposed, will have "no negative <br />effect" on their utility. <br />The only two identified man -made structures are the fence <br />on the boundaries of the property and the overhead power <br />line. Tyler Barton has provided a notarized statement that <br />he has no concerns with the fence. Highline Electric <br />Association has maintained the power line in the same <br />location (south boundary) since the original life of the <br />limited 9.9 operation began in 2000. They were also <br />provided notification of the proposed expansion and have a <br />chance to make any comments before any final decision is <br />made. <br />19. Please provide the Division evidence the Applicant attempted to obtain <br />notarized structure agreements, typically a certified mail receipt, with all owners <br />of the structures on and within 200 feet of the affected area at the Barton Pit or <br />comply with one of the other provisions of Rule 6.4.19. <br />I called Highline Electric Association following the receipt of their notice. <br />They verbally indicated there were no concerns and would not be <br />submitting any comments on the proposed expansion. <br />20. As discussed during the pre - operational inspection, please provide the Division <br />with a notarized letter, on utility letterhead, from the owner of the overhead electric <br />line that mining and reclamation activities, as proposed, will have "no negative <br />effect" on their utility. The Applicant may need to re- evaluate the proposed ten <br />(10) foot buffer proposed in the reclamation plan adjacent to the power poles. <br />The current 10' buffer should be more than adequate to protect the power line <br />that runs along the county road right -of -way. If any issues arise, the buffer <br />will be expanded to safeguard the power line. <br />1 hope the responses provided adequately cover the issues. Please let me know as soon <br />as possible if there need to be additional clarifications or additional information. <br />
