6.4.12 Exhibit L- Reclamation Costs <br />16. The Applicant states 61.3 acres will be affected during the life of the mine, <br />however the Applicant is proposing to only post a reclamation bond for a <br />maximum disturbance of 14.58 acres. Please commit to not disturbing greater <br />than 14.58 acres without notifying the Division and providing additional <br />reclamation bond. Please note disturbance of greater than 14.58 acres may <br />result in a possible violation of the reclamation permit. <br />The applicant is committing to a disturbance no greater than 14.58 <br />acres (Area 1 and Area 2) without notification of the Division. We <br />understand that any increase of the disturbed area will require <br />notification of the Division and an increase in the reclamation bond. <br />17. The Division will estimate the cost to reclaim the site based on the information <br />submitted once the Applicant addresses the concerns noted in this letter. <br />We are assuming that the Division's cost estimate on current <br />financial warranty will be limited to the initial 14.58 acres of <br />disturbance. <br />6.4.14 Exhibit N - Source of Legal Right to Enter <br />18. The source of legal right to enter was not notarized as required by Rule <br />6.3.7. Please provided a signed statement by the Landowner and <br />acknowledged by a Notary Public stating the Operator /Applicant has legal <br />right to enter and mine. <br />A notarized and signed statement is provided. <br />6.4.19 EXHIBITS - Permanent Man -made Structures <br />Where the mining operation will adversely affect the stability of any significant, <br />valuable, and permanent man -made structure located within two hundred (200} feet <br />of the affected land, the applicant may either: <br />a. provide a notarized agreement between the applicant and the person(s) <br />having an interest in the structure, that the applicant is to provide <br />compensation for any damage to the structure; or <br />b. where such an agreement cannot be reached, the applicant shall provide <br />an appropriate engineering evaluation that demonstrates that such <br />structure shall not be damaged by activities occurring at the mining <br />operation; or. <br />
