3. The Division received comments from the Army Corps of Engineers, <br />Colorado Division of Water Resources, and History Colorado. The <br />letters are attached for review. Please address the comments noted <br />in the letters and make any changes to the application as necessary. <br />Corps of Engineers - The mining efforts in the Baton Pit will not require <br />discharge of dredged or fill material in any aquatic site. <br />Division of Water Resources - No comment <br />History Colorado - Should human remains be discovered, the <br />requirements under CRS 24-80 (Part 13) are noted and will be followed. <br />6.4 SPECIFIC EXHIBIT REQUIREMENTS- REGULAR 112 OPERATIONS <br />6.4.1 Exhibit A- Legal Description <br />4. Rule 6.4.1(2) states the mine entrance to the mine site shall be located based <br />on a USGS topographic map showing latitude and longitude or Universal <br />Transverse Mercator (UTM). The Operator will need to specify coordinates of <br />latitude and longitude in degrees, minutes, and seconds or in decimal degrees to <br />an accuracy of at least five (5) decimal places (e.g., latitude 37.12345 N, <br />longitude 104.45678 W). For UTM, the Operator will need to specify North <br />American Datum (NAD) 1927, NAD 1983, or WGS 84, and the applicable zone, <br />measured in meters. <br />The mine entrance location provided by the Operator; 0400 32'42.86"N, 103° 08' <br />57.86" W is not accurate. Please review the location information and update <br />Exhibit A as required. <br />The application used the coordinates from the original filing which are <br />apparently incorrect. The latitude taken with a Garmin GPS is 400 29' <br />44.66" N. The longitude taken with a Garmin GPS is 1030 05'22.84" W. <br />6.4.3 Exhibit C- Pre - mining and Mining Plan Map(s) of Affected Lands <br />5. Rule 6.4.3(8) requires the Applicant to show the owner's name, type of <br />structures, and location of all significant, valuable, and permanent man -made <br />structures contained on the area of affected land and within two hundred (200) <br />feet of the affected land. No structures were identified by the Applicant. Please <br />
