Tom Bird, GCC Energy 29- Nov -2013 <br />C -1981 -035 / TR -20 PAR Page 2 of 12 <br />The Division found the application to be Incomplete for purposes of filing on August 22, 2012. <br />This was due to the proposed final configuration of the coal mine waste backfill not having been <br />described. <br />Supplemental materials were submitted by GCC on February 27, 2013. This submittal included: <br />• Section 2.05.3 pages 2, 3 and 4 (revised); <br />• Section 2.05.4 pages 4, 5 and 5A (revised); <br />• New letter (dated Feb. 12, 2013) to be added to the Trautner report in Appendix 10(4); <br />• Map King 1 -007 Operation Plan & Surface Features (revised); and <br />• Maps Ding 1 -016 and -016A West Waste Bank Design (new). <br />On March 13, 2013, the Division found the TR -20 application to be Complete, and notified La <br />Plata County, OSM, the U.S. Army Corps of Engineers, and the CDPHE Water Quality Control <br />Division. No comments have been received from the various agencies. <br />GCC's public notice appeared in the April 5, 2013 edition of The Durango Herald, as verified by <br />the official Proof of Publication submitted to the Division on April 11, 2013. The period for <br />public comment (2.08.4(6)(b)(ii)) extended for 10 days, closing on April 15, 2013. No <br />comments or objections were received from the general public. <br />ARKS Adequacy Review and Comments <br />The term "Coal Mine Waste" applies to both coal processing waste and underground <br />development waste. Design, construction, operation, inspection, maintenance, and reclamation <br />of Coal Mine Waste Banks, or disposal sites, within the permit boundary is governed by all or <br />portions of Sections 2.05.3($); 4.09.1; 4.09.2; 4.10; and 4.11 of the Regulations of the Colorado <br />Mined Land Reclamation Board for Coal Mining ( "Rules "). Specific portions of the rules are <br />provided here, for your reference. <br />4.09 DISPOSAL OF EXCESS SPOIL; <br />4.10 COAL MINE WASTE BANDS; and 4.11 COAL MINE WASTE <br />4.09.1 General Requirements <br />(1) [See also 4.10.1(1)] All excess spoil shall be transported to and placed in designated <br />disposal areas within a permit area, if disposal areas are authorized for such purposes in the <br />approved permit application in accordance with 4.09. (TR -20 seeks approval for a new <br />disposal area, the "West Waste Bank ".) <br />
