Page 3of10 <br />11. Update regarding prime farmlands <br />The text of pages 2.04 -51 and -52 was revised. A new soil survey was obtained, to be added to <br />Exhibit 14. <br />The revised text has a couple of typographical errors: "... any eagles in the area are already <br />accustom to... " should be corrected to read "... any eagles in the area are already accustomed <br />to..." and "However, no impacts to otters..." should be corrected to read "No impacts to otters... <br />Rule 2.05.2 - Operation Plan — Life of Operations <br />No issues were raised in this section in the original MT6 findings document however the text has <br />been re- formatted, which necessitates a complete review. The following issues were noted: <br />a. The spellcheck function has repeatedly concatenated "train" and "load" in this and <br />subsequent sections, so that what should read as "train loadout" instead reads as <br />"trainload out" <br />b. An unwarranted hyphen appears in the paragraph preceding table 18; <br />c. The affected area and permit area are given as 3,799.5 acres and 4,199.5 acres <br />respectively. These figures do not match those in the permit system (2,899.21 and <br />4,198.90, respectively). Which figures are correct? <br />Rule 2.05.3 - Operation Plan — Permit Area <br />Only a couple of minor issues were raised in this section in the original MT6 findings document <br />(and were mistakenly listed under the header "Rule 2.05.4 — Reclamation Plan General <br />Requirements ") however the entire text (45 pages) has been re- formatted, which necessitates a <br />complete review. <br />12. Page 2.05 -27i needs removed <br />The response is sufficient <br />13. <br />a. Page 2.05 -28 referencing figure <br />The response is sufficient <br />b. On page 2.05 -5 is a passage describing the loading of the RDA conveyor. The passage <br />does not reflect the fact that the temporary conveyor has been removed. Another <br />passage at the end of the same page is also out of date <br />Page 2.05 -6 discusses stockpile volumes and associated costs to remove them. The <br />actual figures are out of date, since —4 unit trains of stockpiled coal has been removed <br />in recent months. In any case, since this section deals with the Operation Plan, it would <br />be logical for the text to be re -written in such a way as to define the volume of <br />stockpiles which are permitted and bonded for, and which could be built up if the mine <br />returns to normal operations. (If NECC wished to apply for bond release based on the <br />recent removal of the stockpiled coal, it would need to be a separate permitting action <br />in which this section would be revised.) <br />d. Table 18a needs units included in the cells or the column headers to avoid ambiguity. <br />Also the cell "Total Current Bond" is misleading — this could simply be changed to <br />"Total", and the row could be differentiated somehow. The lower section of the table <br />could also be made more clear — presumably the rows show volumes of temporary <br />waste stored at different locations, however this is not obvious from the way the table is <br />laid out. <br />
