Mark McLean, P.E. <br />November 12, 2013 <br />DEPLETIONS <br />Page 2 <br />Well permit no. 54064 -F (ID 1406561) was obtained to expose water in this pit. Fremont <br />Paving will continue to mine the site with an allowance to disturb up to 50 acres. This amended <br />plan is based on 12 acres of exposed water surface area for April and May 2013 and 8 acres of <br />exposed water surface area for June 2013 through March 2013, broken down above. The total of <br />12 acres of exposed ground water will result in 31.26 acre -feet of evaporative loss (see attached <br />Table 1). A total of 3.25 acre -feet of water is expected to be consumed by mining operations, <br />consisting of 2.94 acre -feet of water lost in 100,000 tons of aggregate and 0.31 acre -feet used for <br />dust suppression (see attached Table 2). These values differ from the estimates provided in the <br />original 2013 SWSP request letter. The revisions were based on measurements of operational <br />losses over the past 3 years. Total operations with evaporation will result in 34.51 acre -feet of <br />consumptive use. Projected uses and consumption during the 2013 plan year are as shown in the <br />attached Tables 1, 2, and 3. <br />The stream depletion analysis is also attached (see attached Table 3) providing a monthly <br />distribution of the steam depletion. Total stream depletions are calculated to be 37.38 acre -feet for <br />the April 1, 2013 through March 31, 2014 plan year. <br />REPLACEMENT <br />During April 2013 through March 2014, leased 32 acre -feet of fully consumable replacement <br />credits from the Upper Arkansas Water Conservancy District ( "UAWCD ") plus an additional 8.8 acre - <br />feet from the Arkansas Groundwater Users Association ( "AGUA ") available pursuant to a 2 -year <br />lease, will be provided to cover mining depletions. The credits will be generated through the delivery <br />of fully consumable water available to AGUA from the Board of Water Works of Pueblo, from the City <br />of Aurora, or from the Pueblo West Metropolitan District, to AGUA's Excelsior Recharge Ponds <br />located immediately west of Chico Creek. The lease provides that AGUA will deliver up to 30.3 acre - <br />feet to the Arkansas River by means of recharge ponds on the Excelsior Ditch. According to the <br />request, a copy of the lease will be submitted under separate cover. Attached Table 3 shows the <br />proposed monthly replacement schedule for the 2013 plan year. <br />The State and Division Engineers have reviewed the plan and the adequacy of each source <br />of water provided for use as augmentation water, including, where necessary, the historical <br />consumptive use of each water right, and return flows from diversion of waters imported into the <br />Arkansas River Basin or other fully consumable waters proposed for use as augmentation water. <br />CONDITIONS OF APPROVAL <br />This substitute water supply plan is hereby approved pursuant to Section 37 -90- 137(11), <br />C.R.S., subject to the following conditions: <br />1. This current plan shall be valid through March 31, 2014, unless otherwise revoked or modified. <br />2. Active mining of the site shall not exceed 50 acres unless an amendment to this plan has been <br />approved. <br />3. The mined cell must be maintained in a de- watered state to the extent that the exposed water <br />surface area does not exceed a total of 12 acres including all ponds, collection areas, dewatering <br />trenches, and return trenches. <br />
