reclamation standards under SCMRA. The twenty (20) acres of the Morgan Property <br />which are not comprised of prime farmland soils shall be managed identically to the <br />prime farmland areas in terms of revegetation practices. The areas to be reclaimed as <br />prime farmland and non -prime farmland are as depicted in Exhibit 6, attached. <br />C. The 1.9 acre "blast area" immediately north of the Morgan residence shall <br />be designated as a reference area for purposes of comparing crop production and <br />reclamation on all of the disturbed portions of the Morgan Property to pre- mining <br />conditions. Farming plans developed by WFC shall assure that the reference area is <br />managed identically to the disturbed areas of the Morgan Property. <br />d. WFC will implement the topsoil replacement plan attached as Exhibit 7, <br />subject to all changes mandated by this Agreement. WFC agrees to import not less than <br />twenty three thousand (23,000) cubic yards of topsoil from the former Johnson property <br />(now owned by WFC) and emplace same on the east side of the Morgan Property. In <br />addition, WFC agrees to return nine thousand eight hundred (9,800) cubic yards of <br />Morgan topsoil presently stockpiled on the Benson West property to the east side of the <br />Morgan Property. WFC will rip, cross -rip, and rock pick the soils on the Morgan <br />Property prior to placing A and B lift topsoil. Physical and chemical suitability of the <br />imported (Johnson property) topsoil will be approved by DRMS prior to placement. <br />e. Irrigation plans for the Morgan Property will be configured to utilize a <br />center pivot irrigation system. WFC will purchase and install for the duration of this <br />Agreement the western center pivot unit(s) and all necessary pipelines, and incidental <br />equipment. The Morgans will purchase the eastern center pivot unit, which will be <br />owned by the Morgans but installed by WFC. At final bond release WFC will transfer to <br />the Morgans via bill of sale title to the western unit(s) and all related irrigation <br />equipment. Final grading will be performed so as to be compatible with center pivot <br />irrigation. The parties agree to confer and develop a mutually agreeable plan for <br />irrigation of areas which cannot be reached by the center pivot units. WFC will install <br />this incidential irrigation equipment, title to which shall be transferred to the Morgans at <br />final bond release. <br />f. CCC ditch water shall be used for irrigation and reclamation activities on <br />the Morgan Property during all times when it is available. WFC will not utilize pit water <br />from its active mining pit for reclamation or dust control on the Morgan Property at any <br />time. <br />g. WFC agrees to employ best efforts and all reasonably available practices <br />to attain full reclamation of the Morgan Property as soon as practicable. WFC will <br />perform fertility testing on soils within the Morgan Property annually, and will apply <br />fertilizer or other soil amendments or interventions in conformity with all testing <br />recommendations. Soil fertility testing shall conform substantially with the Soil Analysis <br />Report provided by Servi -Tech Laboratories, and attached as Exhibit. Crop rotation on <br />the Morgan Property will include corn and oats. Oats will be planted at a rate of seventy <br />(70) pounds per acre (cover crop) and one hundred (100) pounds per acre (rotation crop). <br />(00158657.2 ) 4 <br />
