Pineda <br />Director <br />I am in receipt of your June 28, 2010 letter regarding reclamation and safeguarding of the Mary McKinney <br />Mine in 1986. Thank you for all the background you provided on the accident and tragic event for your <br />family. <br />The area currently around the Mary McKinney is owned by Cripple Creek and Victor Gold Mining <br />Company (CC &V). They have been actively mining in the Cripple Creek and Victor area with increased <br />production beginning in the 1990s. The landscape around Cripple Creek and Victor has changed in the <br />last 20 years since CC &V increased exploration and operational activities. CC &V has numerous permits <br />with local, state and federal agencies to protect the public, health and environment. The process for <br />permitting and amendments to their operation are publicly noticed and agencies review the permits and <br />regulate numerous operational and reclamation activities at the mine. <br />The mine is planning to expand its operations around the Mary McKinney area. As you know, this <br />proposal or permit amendment has not been submitted for state review. When the permit amendment is <br />submitted, we will review the proposed expansion of operations. In addition, the process offers an <br />opportunity for the public and parties to comment on the proposed activities. <br />In terms of documents in our files, we have not been able to locate any documentation which specifically <br />mentions the incident. Our files contain information related to the actual closure method and process in <br />addition to permission from the landowner of record at the time to safeguard the site. <br />I recently had the opportunity to visit the CC &V mining operations and the Mary McKinney Site. The <br />site is not disturbed and the memorial and shaft closure are still intact. I know that the company has <br />offered to move the memorial and provide a more appropriate setting for remembrance of Wayne. This <br />is a difficult issue, but with understanding on all our parts, I am hoping we can find a resolution suitable <br />to all parties. Remembering Wayne reinforces how important it is to safeguard abandoned mines. <br />Safeguarding hazards continues to be an ongoing effort of our agency to protect the public health and <br />safety of residents and visitors to Colorado's historic mining areas.
