The state never owned the property — we only safeguarded the shaft after it was determined that it was too <br />dangerous to recover the body — there was also some doubt at the time whether the body could really be located. The <br />site is owned by CC &V and they are expanding the mining operation near the shaft. The company has offered to move <br />the memorial and find an appropriate setting but the offer so far has been rejected by the family. We are investigating <br />how much disturbance there will be close to the shaft and I don't believe the shaft itself will be used for the operation <br />and the body would not be disturbed by the activity. Active mining operations are always concerned about liability and <br />they control access to their mining operations —thus they did not feel comfortable in having the memorial so close to <br />their operation. I've asked for more detailed information from our mine regulatory staff and should have more <br />information for you both next week. I'll keep you both informed about our discussions, investigation and hopefully a <br />resolution. <br />Loretta E.
