5. The submitted Reclamation Plan states that the average depth of existing topsoil at the site is <br />3 inches. The Reclamation Plan further states that 3 inches of topsoil will be replaced during <br />reclamation. The application further states that topsoil may be exported from the site. The Division <br />requires a minimum of 6 inches of topsoil replacement during reclamation, unless the existing topsoil <br />at the site does not allow for this amount of replacement. Therefore, if there is enough topsoil at the <br />site to provide 6 inches of topsoil replacement, the Division will require that 6 inches of topsoil be <br />replaced during reclamation. Since the submitted information indicates that the existing topsoil at <br />the site will not allow for 6 inches of topsoil during reclamation, if the operator desires to export <br />topsoil, a technical revision to the permit will be required prior to export, to show the Division that <br />there is adequate topsoil for reclamation. <br />6. The proposed Reclamation Plan states, "Reclamation will be deemed to have been <br />accomplished when vegetative cover is at least 70% of cover (the natural vegetation) of the <br />surrounding area in grass, and erosion/sedimentation is equal to or less than that of the original <br />conditions of the site with any change in slopes taken into account." The statement regarding <br />vegetative cover is in direct conflict with rule 3.1.10(1) and the Division will not base its <br />consideration of reclamation success on these parameters. <br />Rule 6.4.19 EXHIBIT S Permanent Man -made Structures <br />7. Please submit the agreement between the owners of the remaining structures and the <br />applicant, or proof of mailing of these agreements. If an agreement cannot be obtained, additional <br />information will be needed to allow the Division to perform an engineering assessment of the stability <br />of the proposed plan. <br />Please be advised that the Stone Sand & Gravel, LLC, Wallace Pit Conversion Application may be <br />deemed inadequate, and the application may be denied December 23, 2013 unless the above <br />mentioned adequacy review items are addressed to the satisfaction of the Division. Responses to these <br />adequacy concerns must be received by the Division to allow adequate time for review prior to the <br />decision date. If you feel more time is needed to complete your reply, the Division can grant an <br />extension to the decision date. This will be done upon receipt of a written waiver of your right to a <br />decision by December 23, 2013 and request for additional time. This request must be received no <br />later than December 23, 2013. Please be aware that depending on the answers that are received <br />regarding the above adequacy issues, the Division may have further adequacy questions.
