Hickenlooper
Govemor
Mike King
Executive Director
Loretta E. PiAeda
Director
Listed below are adequacy review comments for the Wallace Pit Conversion Application, File No. M-
1983 -028. The decision date for this application is December 23, 2013. The Division of Reclamation,
Mining, and Safety (Division) is required to make a decision by December 23, 2013. Therefore, your
response to the following adequacy review concerns should be submitted to the Division as soon as
possible.
1. As required by Rule 1.6.5 (2), please submit the proof of publication of the public notice
circulated in the local newspaper and all owners of record of surface lands, and easement holders that
are on the affected land and within 200 feet of the boundary of the affected land, if applicable. Proof
of notice may be return receipts of a Certified Mailing or proof of personal service.
2. Due to an area within this proposed conversion area currently being contained within the
permit boundary of the Hay Camp Pit, File M -1990 -025, please note that an Acreage Reduction
request will be necessary upon approval of this permit, removing the overlapping acreage from permit
M- 1990 -025. This is merely an administrative formality.
Rule 6.4.2 Exhibit B — Index Map
3. The submitted map indicates the names of the adjacent landowners, but the locations of each
owner's properties are unclear, based on the information submitted. Please indicate which landowner
owns each piece of adjacent property.
Rule 6.4.5 Exhibit E — Reclamation Plan
4. The reclamation plan indicates that maximum reclaimed slope at the site will be 2H:1 V. The
proposed post mining land use for the site is rangeland. The Division requires a maximum slope of
314:1 V for rangeland, unless there are extenuating circumstances preventing this final slope angle.
During the inspection, it was indicated that the 2:1 slopes will be limited to the area surrounding the
power line tower. Please indicate that these slopes will be limited to this area.
Office of Office of
