In the event of a "call" on the Dolores River Basin by senior water right holders, <br />ponded water in the JD -6 Mine SWRP will be pumped out using a sump pump. The <br />water will be pumped and discharged over the spillway into the natural drainage. The <br />sump pump will be placed in the lowest point of the pond that can be reasonably <br />pumped without excessive sediment intake. <br />d. Cotter commits to breaching the embankment upon closure. This BMP has been <br />added to Section 6 of the revised DDP. <br />12. Page 30, Section 6.1. The last bullet suggests silt fence will be placed in the ephemeral - <br />drainage. Silt fence is ineffective and will fail when subjected to concentrated flow. Please <br />clarify the intent to use silt fence in this instance. <br />Cotter response: The silt fence currently exists below the toe of the waste rock pile. It <br />was installed to retain sediment that could migrate from the slope face of the waste rock <br />pile into the adjacent ephemeral drainage. The text has been modified to more clearly <br />indicate that the fence was constructed along the toe of the pile, and not directly within <br />the channel. <br />13. Page 36, Attachment 3. As noted in Comment 11, design drawings stamped and signed by a <br />professional engineer registered in Colorado is required for spillways as well as all other <br />engineered structures associated with stormwater controls related to the EPP. <br />Cotter response: The revised DPP contains design drawings for engineered structures <br />that are signed and stamped by a Colorado licensed professional engineer (P.E.) <br />4148A.131030 9 <br />
