I,Jared Ebert of the Colorado Division of Reclamation,Mining and Safety(Division)conducted the
inspection. Mr.Forrest Luke with TMI accompanied me on the inspection. The weather was clear and sunny.
BACKFILL and GRADING—Rule 4.14; Contemporaneous Reclamation 4.14.1;Approximate Original Contour
4.14.2;Highwall Elimination 4.14.1(2)(f); Steep Slopes 4.14.2,4.27; Handling of Acid and Toxic Materials
4.14.3; Stabilization of Rills and Gullies 4.14.6:
TMI submitted a Phase I bond release application for 120.4 acres of affected land within portions of the Z-Pit,Ash
Disposal Pit and K-Pit. Specifically 75.4 acres in Parcel Z-A-13, 15.6 acres in Parcel A-B-13 and 29.4 acres in
Parcel K-A-13. The Division evaluates the reclamation parcels to determine if the affected areas have been
backfilled and graded in accordance with the approved post mine topography. These parcels can be viewed on the
SL15 Bond Release maps.
Part of the evaluation of these parcels for Phase 1 bond release is that the Division compares the approved Post
Mining Topography(PMT)as depicted on Map M12 in the permit to the actual on the ground topography after
backfilling and grading has occurred. Trapper submitted on map that depicts the actual on the ground topography
after backfilling and grading occurred;the SL15 bond release map. During the field inspection, the Division
confirms the on-the-ground topography using a YUMA GPS unit.
Using ArcMap 10,the Division is able geo-reference the approved PMT Maps and the SL15 Bond Release Maps.
These maps can overlay each other allowing for a visual comparison of the topography. The Division then places
transects through the reclamation parcels to be evaluated. Along each transect, multiple sample points are placed
where the transect intersects a contour line on the PMT map,map M12 from the permit. The elevation of each of
these points is interpolated from the PMT maps and the SL15 maps. During the ground inspection, the Division
walks each of these transects and logs the elevation at each sample point using a Trimble YUMA GPS unit. Many
variables affect the precision of the elevations measured with the GPS unit, however the error in the elevation
Number of Partial Inspection this Fiscal Year: 3
Number of Complete Inspections this Fiscal Year: 1
Page 2 of 8
