considered to be a spoil spring site. At the Fish Creek Tipple, the springs emanating from the upslope side of Pond E are measured semiannually for flow and field parameters. A full suite sample is collected for analysis at that time as well. In addition to monitoring these particular spoil spring sites, the area surrounding the Fish Creek Tipple is incorporated into the annual spring survey. This annual May survey was established in the hydrologic monitoring program of Colorado Yampa Coal Company's Permit C -81 -071. If additional springs are discovered, further monitoring requirements will be accomplished in accordance with the spoil spring monitoring plan. Details regarding the sampling schedule and tested parameters for both natural and spoil springs are located in Exhibit 14, Hydrologic Monitoring Plan. Discharge from the underground mine will be sampled at two locations: Site 109 and Site 115. Site 109 is located near the main portals and the discharge water is piped the pit south of Pond D and then enters Pond D via the channel between the pit and the pond before entering Foidel Creek, or alternatively, it is piped to Site 114 where it is eventually used for underground dust suppression. Discharge of excess groundwater inflows (temporary — during shaft excavation only) from the 6NM Shaft is sampled at Site 121. Site 115 is located northwest from the main portal area. The water at this site is detained within a series of impoundments before its discharge to Fish Creek. Site 109 is sampled for a full suite analysis quarterly while Site 115 is sampled per the requirements of the NPDES Permit CO- 0042161. At both sites, water discharge meters have been installed to monitor the quantity of mine discharge. A flume at Site 121 is used to measure discharge of excess groundwater inflows. Responsible for meeting the effluent limitations mandated by NPDES Permit CO- 0027154 transferred from the Colorado Yampa Coal Company (CYCC) to TCC at the time of final bond release for the Eckman Park Mines. TCC is directly responsible for NPDES Permit Nos. CO- 0036684 and CO- 0042161. Permit No. CO- 0036684 establishes the effluent limitations for the Fish Creek Tipple. Permit No. CO- 0042161 governs flow at the Fish Creek Dewatering Facility. The dewatering facility permit, issued in July of 1989, establishes effluent limitations for mine discharge only; surface flow does not enter the impoundment structures. A temporary Construction Dewatering Discharge Permit (Permit No. COG - 0072272) was issued for discharge of excess groundwater inflows to the 6NM Shaft during shaft excavation. As with ground water monitoring, necessary surface water measurements and sample analysis will utilize standard EPA measurement methods and ASTM test procedures. A list of the surface water parameters, which will be analyzed, is presented as Table C of the Hydrologic Monitoring Plan (Exhibit 14). Effluent limitations for discharges from sedimentation control and mine discharge structures are specified in one of four NPDES Permits: CO- 0027154, CO- 0036684, CO- 0042161, and COG - 0072272. The NPDES Permits are located in Exhibit 30 (Volume III), Exhibit 10 (Volume VIII), and Exhibit 44 (Volume IIIA), respectively. In order to directly monitor the effect of mining into the saturated overburden unit, a mine water inflow survey will be conducted once per year. The survey will consist of on -site measurement of water inflow where it occurs in the mine, using bucket - and - stopwatch, portable weirs or flumes, and estimates of flow in areas where direct measurement is not possible. The results of the survey will be plotted on a map of the mine and submitted as part of the annual hydrologic monitoring reports. Documentation and Reporting All surface and ground water monitoring data will be permanently recorded and maintained in the TCC or Colorado Yampa Coal Company files The data required under the different NPDES Permits will be filed on a monthly or quarterly basis, depending on the specific permit. TCC will submit a separate letter of notification to the CDMG of the NPDES filing. If a discharge from a sedimentation control structure exceeds the NPDES effluent limitations, TCC will notify the CDMG per the NPDES permit reporting requirements. The NPDES data will continue to be incorporated into the annual hydrologic report. An Annual Hydrology Report summarizing all monitoring data for the water year from October through September (a "water year ") will be submitted to the regulatory agency by February 28 of the following year.
