Laboratory analytical results from the Soil SAP were added to the permit with MR -84. The <br />application for MR -84 was received on May 25, 2012, and deemed complete on June 6. <br />Adequacy reviews were issued on June 18 and June 22, 2012. On June 25, 2012, the Division <br />issued its decision to approve MR -84. <br />The soil data collected in late 2011 were utilized by WFC to develop a revised reclamation plan <br />for the Morgan property, including the prime farmland acreage, topsoil replacement, and <br />revegetation. This plan was submitted as Permit Revision No. 7 (PR -7) on December 24, 2012. <br />The application was deemed complete on January 3, 2013. Public Notice was published on <br />January 17, 24, 31 and February 7. The comment period came to a close on March 11, 2013. <br />Numerous objections to PR -7 were received by the Division, and were transmitted to WFC. Due <br />to a pending settlement agreement between WFC and the Morgans, no informal conference was <br />convened, and the PR -7 application was formally withdrawn on June 6, 2013. The Division <br />issued its proposed decision to accept the withdrawal request on June 13, 2013, and notified the <br />various objectors by mail. Public notice of the decision was published in the San Miguel Basin <br />Forum on June 27 and July 4, 2013. No comments or objections were received. <br />Other Revisions <br />WFC submitted an application for PR -8 on September 26, 2013. The application was deemed to be <br />complete for purposes of filing on October 4, 2013. With PR -8, WFC proposes to address prime <br />farmland reclamation practices, including topsoil redistribution and revegetation plans; replacement <br />of the irrigated cropland technical standard with a reference are; and the determination of prime <br />farmland areas. <br />TR -60 provided as -built plans for Pond 015, and incorporated an updated version of the mine's <br />NPDES permit. The application was received on June 8, 2011, and deemed complete on June 20, <br />2011. Public notice appeared on June 23, 2011. Adequacy reviews were issued on August 15 and <br />November 10, 2011, and the Division issued a proposed decision to approve TR -60 on November <br />30, 2011. Public notice was published on December 8, 2011. No objections were received. <br />MR -78 modified the permit to allow for a seismic survey to be conducted in the New Horizon Mine <br />1 permit area for the purpose of identifying the location of the old highwall. The application was <br />received on December 15, 2010, and approved on December 17, 2010. <br />MR -79 incorporated details for the repair of irrigated areas that may experience differential <br />settlement. The application was received on January 5, 2011 and approved on March 21, 2011. <br />MR -80 updated Section 2.03.4 of the permit. The application was received on March 23 and <br />approved on March 28, 2011. <br />MR -81 revised the management of the Irrigated Pasture Reference Area to allow for haying and / or <br />grazing. The application was received and deemed complete on August 8, 2011, and approved on <br />November 1, 2011 following two adequacy reviews. <br />11 <br />
