McAtee Construction Company, Inc. Page 2
Riverside Pit - M- 1976 -056
and below water slopes were done, and most of the revegetation was
done making the area nearly ready for release. The flooding
virtually wiped out all that reclamation work except for on a narrow
band of land along the west side of the area. The western shore of
the lake is now the west bank of the river and there is no indication
that this will change soon. Unless the river is diverted back to
the old channel up stream on land not controlled by McAtee
Construction Co. this area will remain river bottom. We feel one
option would be to declare that the flooding destroyed the Lake Robert
area and request that responsibility for further reclamation be
released and the area would be removed from the permit. This would
be done because, rebuilding the area to pre -flood conditions is cost
prohibitive and may not be possible if the river remains flowing thru
it.
At this point we are not sure what actions we need to pursue
on the Lake Robert area by either releasing it from the permit or
what other responsibilities we have to restore it as shown in the
permit. We are requesting that the Division determine what options
we have for dealing with this area and give us some direction on how
we accomplish the various options presented or you propose using the
Division's permitting process.
Thank you for your help and advice and if you have any questions
or need more information please call me.
Sincerely,
McAtee Construction Co.
Darren Gebhart
Construction Manager
cc Environment, Inc. - Steve O =Brian
