10/15/13 State.co.us Executive Branch Mail - Fwd: Objection and Request for a Board Hearing re TR40
of wood that is blocking it. I planned to see if there
was water in MWNW on Monday Oct 7th when I was
on site with the Division of Water Resources looking
into the tag that they had placed on MWNW when
EFCI was using it illegally to dewater the mine.
Permit #12508AD (application denied) 7/22/1991
Brodgen, EFCI consultants did a report in 1987
and are very aware of the dewatering and inflow of
140- 150AC /FT being removed. DRMS required a
permit from the Division of Water Resources or a
closed -loop system in 1994. (Technical Revision 19,
a response to Stipulation No.20. Oct 14,1994) The
CDWR has not given me an answer if this system
required a permit or an augmentation plan on the
Arkansas River.
And this may be the reason for the 200 year
projection in their current report for the mine voids to
fill up.
The Division of Reclamation, Mining and Safety staff
and the Board are the responsible agency for water
quantity and quality regarding mines in Colorado. In
34 -33 -102 Article 33 Legislative declaration "surface
mining operations and the reclamation of the land
affected by such operations are both necessary and
proper activities. EFCI has mined the Southfield Mine
for 20 years and received the financial benefit. My
family has been involved in mining in Colorado for
125 years (two grandfathers were killed in mines.
Tony Vento, my other grandfather started the Vento
Coal Mine 78 years ago (Southfield in 1935). It is the
further intent of the General Assembly that land that
was mined prior to this act and after be reclaimed
https: / /mai l.g oog le.conVmai 1 /u /0 / ?ui =2 &i Ire29129fcb5 &view = pt &search =i nbox&th =141 bd422efaa8cbe 3/4
