I planned to see if there <br />was water in MWNW on Monday Oct 7th when I was <br />on site with the Division of Water Resources looking <br />into the tag that they had placed on MWNW when <br />EFCI was using it illegally to dewater the mine. <br />Permit #12508AD (application denied) 7/22/1991 <br />Brodgen, EFCI consultants did a report in 1987 <br />and are very aware of the dewatering and inflow of <br />140- 150AC /FT being removed. DRMS required a <br />permit from the Division of Water Resources or a <br />closed -loop system in 1994. (Technical Revision 19, <br />a response to Stipulation No.20. Oct 14,1994) The <br />CDWR has not given me an answer if this system <br />required a permit or an augmentation plan on the <br />Arkansas River. <br />And this may be the reason for the 200 year <br />projection in their current report for the mine voids to <br />fill up. <br />The Division of Reclamation, Mining and Safety staff <br />and the Board are the responsible agency for water <br />quantity and quality regarding mines in Colorado. In <br />34 -33 -102 Article 33 Legislative declaration "surface <br />mining operations and the reclamation of the land <br />affected by such operations are both necessary and <br />proper activities. EFCI has mined the Southfield Mine <br />for 20 years and received the financial benefit. My <br />family has been involved in mining in Colorado for <br />125 years (two grandfathers were killed in mines. <br />Tony Vento, my other grandfather started the Vento <br />Coal Mine 78 years ago (Southfield in 1935).
