10/15/13 State.co.us Executive Branch Mail - Fwd: Objection and Request for a Board Hearing re TR40
TO:Division of Reclamation, Mining and Safety Staff
and Board
FROM: K2T LLC, Linda Saunders property owner
and manager
RE: Board Hearing on TR40
In my July 18, 2013 Objection I requested a hearing
if the DMRS decides that Energy Fuels Coal Inc no
longer needs to monitor MWNW. Since I have
already requested that this issue me heard by the
board, I am reminding you that a hearing with the
Board is required.
EFCI needs to continue monitoring the mine
workings as part of their Hydrologic Plan according to
the DRMS regulations 4.05.13(1)(a), 4.05.13(1)
( c), 4.05.13(1)(e)e(I),4.05.13(3)(a) 4.0513(3)(b).
To not monitor would be non - compliance with these
regulations.
At the meeting with Janet and Dan in January 2012
we asked that the DRMS enforce their own
regulations and stop the stipulations and Technical
Revisions at EFCI request.
Kent Gorham, the previous inspector in his 2009
Annual Hydrology Review stated "Until water is
measured in MWNW (completed in the mine
workings, no conclusion regarding the ground water
(filling the mine voids) and quality can be made.
Continued monitoring in accordance with the
approved plan may provide more definitive
information in the future.
Also Janet Binns cited and fined EFCI NOV CV -2013-
002.
EFCI damaged MWNW and has not removed a piece
https: / /mai l.g oog le.conVmai 1 /u /0 / ?ui =2 &i Ire29129fcb5 &view = pt &search =i nbox&th =141 bd422efaa8cbe 2/4
